English term

sentence

English Medical Law: Contract(s) Clinical Trial Study
C. Any such Administrative Startup fee payment to INSTITUTION shall not be provided under the terms of the anticipated Clinical Study Agreement between XY and YZ and shall instead be provided to YZ.

I am translating a clinical trial agreement into Croatian and I am not sure I understand this sentence. Could someone rephrase it. Thanks a lot

It doesn't make sense, as it appears to contradict itself, and the meaning of "provided" is not clear. I'd just put a translator's note saying "text garbled".
mike23 Feb 16, 2016:
Perhaps they meant sth like that:
The payment will not be made to INSTITUTION(=YZ) under the anticipated Clinical Study Agreement between XY and YZ but instead of that it will be made to YZ outside (not under the terms of) the anticipated CS Agreement??
sazo (asker) Feb 16, 2016:
@Mike, The whole sentence seems wrong to me. I've asked for a clarification, but I am afraid I won't get it.
mike23 Feb 16, 2016:
Yes, I can see that. My clarification is wrong then.
sazo (asker) Feb 16, 2016:
@Mike, the institution is YZ as well.
sazo (asker) Feb 16, 2016:
@ Now, I've noticed that I didn't mention that the institution is also YZ. The correct sentence would be "Any such Administrative Startup fee payment to YZ shall not be provided under the terms of the anticipated Clinical Study Agreement between XY and YZ and shall instead be provided to YZ."

rephrased below

C. Under the terms of the anticipated Clinical Study Agreement between XY and YZ any such Administrative Startup fee payment which arises shall be provided soley to (the institution) YZ (and not to XY).

The parts in brackets are not necessary but just provided for extra clarification

C. Any such Administrative Startup fee payment to the INSTITUTION shall not be provided under the terms of the future Clinical Study Agreement between XY and YZ, but shall be provided to YZ instead..

Presumably the terms of the Clinical Study Agreement will specify that payment will not be to YZ, but to XY or someone else.

Hope this helps.

neutral philgoddard : I still think this is a bit hard to understand. You don't provide a fee payment, you pay a fee.

explanation

I think the meaning could be:

"Any such Administrative Startup fee shall be paid directly to YZ regardless of the terms of the anticipated Clinical Study Agreement between XY and YZ".
