A. INTRODUCTION
1. The World Medical Association (WMA) has developed the Declaration of Helsinki as a statement of ethical principles for medical research involving human subjects, including research on identifiable human material and data.
The Declaration is intended to be read as a whole and each of its constituent paragraphs should not be applied without consideration of all other relevant paragraphs.
2. Although the Declaration is addressed primarily to physicians, the WMA encourages other participants in medical research involving human subjects to adopt these principles.
3. It is the duty of the physician to promote and safeguard the health of patients, including those who are involved in medical research. The physician's knowledge and conscience are dedicated to the fulfilment of this duty.
4. The Declaration of Geneva of the WMA binds the physician with the words, “The health of my patient will be my first consideration,” and the International Code of Medical Ethics declares that, “A physician shall act in the patient's best interest when providing medical care.”
5. Medical progress is based on research that ultimately must include studies involving human subjects. Populations that are underrepresented in medical research should be provided appropriate access to participation in research.
6. In medical research involving human subjects, the well-being of the individual research subject must take precedence over all other interests.
7. The primary purpose of medical research involving human subjects is to understand the causes, development and effects of diseases and improve preventive, diagnostic and therapeutic interventions (methods, procedures and treatments). Even the best current interventions must be evaluated continually through research for their safety, effectiveness, efficiency, accessibility and quality.
8. In medical practice and in medical research, most interventions involve risks and burdens.
9. Medical research is subject to ethical standards that promote respect for all human subjects and protect their health and rights. Some research populations are particularly vulnerable and need special protection. These include those who cannot give or refuse consent for themselves and those who may be vulnerable to coercion or undue influence.
10. Physicians should consider the ethical, legal and regulatory norms and standards for research involving human subjects in their own countries as well as applicable international norms and standards. No national or international ethical, legal or regulatory requirement should reduce or eliminate any of the protections for research subjects set forth in this Declaration.
B. PRINCIPLES FOR ALL MEDICAL RESEARCH
11. It is the duty of physicians who participate in medical research to protect the life, health, dignity, integrity, right to self-determination, privacy, and confidentiality of personal information of research subjects.
12. Medical research involving human subjects must conform to generally accepted scientific principles, be based on a thorough knowledge of the scientific literature, other relevant sources of information, and adequate laboratory and, as appropriate, animal experimentation. The welfare of animals used for research must be respected.
13. Appropriate caution must be exercised in the conduct of medical research that may harm the environment.
14. The design and performance of each research study involving human subjects must be clearly described in a research protocol. The protocol should contain a statement of the ethical considerations involved and should indicate how the principles in this Declaration have been addressed. The protocol should include information regarding funding, sponsors, institutional affiliations, other potential conflicts of interest, incentives for subjects and provisions for treating and/or compensating subjects who are harmed as a consequence of participation in the research study. The protocol should describe arrangements for post-study access by study subjects to interventions identified as beneficial in the study or access to other appropriate care or benefits.
15. The research protocol must be submitted for consideration, comment, guidance and approval to a research ethics committee before the study begins. This committee must be independent of the researcher, the sponsor and any other undue influence. It must take into consideration the laws and regulations of the country or countries in which the research is to be performed as well as applicable international norms and standards but these must not be allowed to reduce or eliminate any of the protections for research subjects set forth in this Declaration. The committee must have the right to monitor ongoing studies. The researcher must provide monitoring information to the committee, especially information about any serious adverse events. No change to the protocol may be made without consideration and approval by the committee.
16. Medical research involving human subjects must be conducted only by individuals with the appropriate scientific training and qualifications. Research on patients or healthy volunteers requires the supervision of a competent and appropriately qualified physician or other health care professional. The responsibility for the protection of research subjects must always rest with the physician or other health care professional and never the research subjects, even though they have given consent.
17. Medical research involving a disadvantaged or vulnerable population or community is only justified if the research is responsive to the health needs and priorities of this population or community and if there is a reasonable likelihood that this population or community stands to benefit from the results of the research.
18. Every medical research study involving human subjects must be preceded by careful assessment of predictable risks and burdens to the individuals and communities involved in the research in comparison with foreseeable benefits to them and to other individuals or communities affected by the condition under investigation.
19. Every clinical trial must be registered in a publicly accessible database before recruitment of the first subject.
20. Physicians may not participate in a research study involving human subjects unless they are confident that the risks involved have been adequately assessed and can be satisfactorily managed. Physicians must immediately stop a study when the risks are found to outweigh the potential benefits or when there is conclusive proof of positive and beneficial results.
21. Medical research involving human subjects may only be conducted if the importance of the objective outweighs the inherent risks and burdens to the research subjects.
22. Participation by competent individuals as subjects in medical research must be voluntary. Although it may be appropriate to consult family members or community leaders, no competent individual may be enrolled in a research study unless he or she freely agrees.
23. Every precaution must be taken to protect the privacy of research subjects and the confidentiality of their personal information and to minimize the impact of the study on their physical, mental and social integrity.
24. In medical research involving competent human subjects, each potential subject must be adequately informed of the aims, methods, sources of funding, any possible conflicts of interest, institutional affiliations of the researcher, the anticipated benefits and potential risks of the study and the discomfort it may entail, and any other relevant aspects of the study. The potential subject must be informed of the right to refuse to participate in the study or to withdraw consent to participate at any time without reprisal. Special attention should be given to the specific information needs of individual potential subjects as well as to the methods used to deliver the information. After ensuring that the potential subject has understood the information, the physician or another appropriately qualified individual must then seek the potential subject’s freely-given informed consent, preferably in writing. If the consent cannot be expressed in writing, the non-written consent must be formally documented and witnessed.
25. For medical research using identifiable human material or data, physicians must normally seek consent for the collection, analysis, storage and/or reuse. There may be situations where consent would be impossible or impractical to obtain for such research or would pose a threat to the validity of the research. In such situations the research may be done only after consideration and approval of a research ethics committee.
26. When seeking informed consent for participation in a research study the physician should be particularly cautious if the potential subject is in a dependent relationship with the physician or may consent under duress. In such situations the informed consent should be sought by an appropriately qualified individual who is completely independent of this relationship.
27. For a potential research subject who is incompetent, the physician must seek informed consent from the legally authorized representative. These individuals must not be included in a research study that has no likelihood of benefit for them unless it is intended to promote the health of the population represented by the potential subject, the research cannot instead be performed with competent persons, and the research entails only minimal risk and minimal burden.
28. When a potential research subject who is deemed incompetent is able to give assent to decisions about participation in research, the physician must seek that assent in addition to the consent of the legally authorized representative. The potential subject’s dissent should be respected.
29. Research involving subjects who are physically or mentally incapable of giving consent, for example, unconscious patients, may be done only if the physical or mental condition that prevents giving informed consent is a necessary characteristic of the research population. In such circumstances the physician should seek informed consent from the legally authorized representative. If no such representative is available and if the research cannot be delayed, the study may proceed without informed consent provided that the specific reasons for involving subjects with a condition that renders them unable to give informed consent have been stated in the research protocol and the study has been approved by a research ethics committee. Consent to remain in the research should be obtained as soon as possible from the subject or a legally authorized representative.
30. Authors, editors and publishers all have ethical obligations with regard to the publication of the results of research. Authors have a duty to make publicly available the results of their research on human subjects and are accountable for the completeness and accuracy of their reports. They should adhere to accepted guidelines for ethical reporting. Negative and inconclusive as well as positive results should be published or otherwise made publicly available. Sources of funding, institutional affiliations and conflicts of interest should be declared in the publication. Reports of research not in accordance with the principles of this Declaration should not be accepted for publication.
C. ADDITIONAL PRINCIPLES FOR MEDICAL RESEARCH COMBINED WITH MEDICAL CARE
31. The physician may combine medical research with medical care only to the extent that the research is justified by its potential preventive, diagnostic or therapeutic value and if the physician has good reason to believe that participation in the research study will not adversely affect the health of the patients who serve as research subjects.
32. The benefits, risks, burdens and effectiveness of a new intervention must be tested against those of the best current proven intervention, except in the following circumstances:
• The use of placebo, or no treatment, is acceptable in studies where no current proven intervention exists; or
• Where for compelling and scientifically sound methodological reasons the use of placebo is necessary to determine the efficacy or safety of an intervention and the patients who receive placebo or no treatment will not be subject to any risk of serious or irreversible harm. Extreme care must be taken to avoid abuse of this option.
33. At the conclusion of the study, patients entered into the study are entitled to be informed about the outcome of the study and to share any benefits that result from it, for example, access to interventions identified as beneficial in the study or to other appropriate care or benefits.
34. The physician must fully inform the patient which aspects of the care are related to the research. The refusal of a patient to participate in a study or the patient’s decision to withdraw from the study must never interfere with the patient-physician relationship.
35. In the treatment of a patient, where proven interventions do not exist or have been ineffective, the physician, after seeking expert advice, with informed consent from the patient or a legally authorized representative, may use an unproven intervention if in the physician's judgement it offers hope of saving life, re-establishing health or alleviating suffering. Where possible, this intervention should be made the object of research, designed to evaluate its safety and efficacy. In all cases, new information should be recorded and, where appropriate, made publicly available.

A. INTRODUCCION
1. La Asociación Médica Mundial (AMM) ha promulgado la Declaración de Helsinki como un pronunciamiento de principios éticos para la investigación médica que involucra a seres humanos, incluida la investigación de material humano y de información identificables.
La Declaración debe ser leída en su totalidad como una unidad y no debe aplicarse separadamente ninguno de sus párrafos sin tener en cuenta todos los demás párrafos relevantes que la conforman.
2. Aunque la Declaración está dirigida fundamentalmente a los médicos, la AMM insta a los otros participantes de la investigación médica en seres humanos a adoptar sus principios.
3. El deber del médico es promover y salvaguardar la salud de los pacientes, incluidos aquellos que están involucrados en la investigación médica. La conciencia y los conocimientos del médico han de subordinarse al cumplimiento de este deber.
4. La Declaración de Ginebra de la Asociación Médica Mundial obliga al médico con la premisa “priorizar y velar solícitamente por la salud de mi paciente”, y el Código Internacional de Ética Médica declara que “El médico debe actuar en consideración de lo mejor para el paciente cuando brinde atención médica”.
5. El progreso de la medicina se sustenta en la investigación que, en última instancia, debe incluir estudios que involucren seres humanos. A las poblaciones que están subrepresentadas en la investigación médica se les debe dar acceso adecuado a la participación en la investigación.
6. En la investigación médica en seres humanos, el bienestar del individuo que participa en la investigación debe tener primacía por sobre todos los demás intereses.
7. El principal propósito de la investigación médica en seres humanos es comprender las causas, la evolución y los efectos de las enfermedades y mejorar los procedimientos profilácticos, diagnósticos y terapéuticos (métodos, procedimientos y tratamientos). Incluso, los mejores procedimientos intervencionistas actuales deben ser evaluados continuamente, a través de la investigación, para confirmar que sean seguros, efectivos, eficientes, accesibles y de calidad.
8. En la práctica de la medicina y en la investigación médica, la mayoría de los procedimientos intervencionistas implican riesgos y efectos colaterales.
9. La investigación médica está sujeta a normas éticas destinadas a promover el respeto a todos los seres humanos y proteger su salud y sus derechos individuales. Algunas poblaciones sometidas a investigación son particularmente vulnerables y requieren una protección especial. Éstas incluyen a aquellos que no pueden otorgar o negarse a dar el consentimiento por sí mismos y aquellos que pueden ser vulnerables a la coerción o a la influencia indebida.
10. Los médicos deben tener en cuenta las normas y disposiciones éticas, legales y jurídicas para llevar a cabo investigaciones en seres humanos vigentes en sus propios países como también las normas y disposiciones internacionales aplicables. Ningún requerimiento ético, legal o jurídico nacional o internacional podrá menoscabar o eliminar una medida de protección para los seres humanos que participan en la investigación establecida en esta Declaración.
B. PRINCIPIOS BASICOS PARA TODA INVESTIGACION MÉDICA
11. Los médicos que se dedican a la investigación médica tienen el deber de proteger la vida, la salud, la dignidad, la integridad, el derecho a la autodeterminación, la privacidad y la confidencialidad de la información personal de los sujetos que participan en una investigación.
12. La investigación médica en seres humanos debe cumplir con los principios científicos generalmente aceptados, y debe sustentarse en un conocimiento cabal de la bibliografía científica, otras fuentes de información pertinentes así como en la experimentación de laboratorio correctamente realizada y, si correspondiera, en animales. Se debe respetar el bienestar de los animales utilizados en la investigación.
13. Deberán tomarse las precauciones necesarias cuando se lleve a cabo una investigación médica que pudiera dañar el medio ambiente.
14. El diseño y el desarrollo de cada estudio de investigación que involucre seres humanos deberán estar claramente formulados en un protocolo de investigación. Dicho protocolo deberá contener una declaración de las consideraciones éticas referidas en este caso y deberá indicar expresamente de qué manera se han aplicado los principios enumerados en la presente Declaración. El protocolo deberá incluir información respecto del financiamiento y del patrocinio, las afiliaciones institucionales, otros posibles conflictos de intereses, incentivos para los sujetos participantes y disposiciones relativas al tratamiento y/o compensación de los sujetos que hubieren sufrido algún daño como consecuencia de su participación en el estudio de investigación. El protocolo debe describir los pasos previstos para el acceso posterior al estudio por parte de los sujetos del estudio a los procedimientos intervencionistas del estudio identificados como beneficiosos o el acceso a otra atención adecuada o beneficios.
15. El protocolo de investigación deberá ser sometido a la consideración, el comentario, las sugerencias y la aprobación de un comité de ética en investigación antes de comenzar el estudio. Este comité deberá ser independiente del investigador, del patrocinante y de cualquier otro tipo de influencia indebida. El comité deberá tener en cuenta las leyes y reglamentaciones del país o los países donde se ha de llevar a cabo la investigación así como todas las normas y disposiciones internacionales aplicables, pero éstas no podrán menoscabar o eliminar ninguna de las medidas de protección disponibles para los sujetos que participan en una investigación establecidas en esta Declaración. El comité tiene la facultad de monitorear los estudios en curso. El investigador tiene la obligación de suministrar al comité información sobre los controles efectuados, en particular información sobre cualquier evento adverso serio que se produzca. No podrá realizarse ningún cambio al protocolo sin la debida consideración y aprobación por parte del comité.
16. La investigación médica en seres humanos deberá ser llevada a cabo exclusivamente por personas idóneas con una adecuada formación científica. La investigación en pacientes o voluntarios sanos requiere la supervisión de un médico competente u otro profesional del cuidado de la salud debidamente calificado. La responsabilidad de proteger a las personas que forman parte de una investigación debe recaer siempre en el médico u otro profesional de la salud y nunca en los participantes de la investigación, aún cuando éstos hubieren otorgado su consentimiento.
17. La investigación médica que involucre una población o comunidad vulnerable o en desventaja sólo se justifica si la investigación responde a las necesidades y prioridades de salud de esta población o comunidad y si existen posibilidades razonables de que esta población o comunidad, sobre la que se realiza la investigación, se vea beneficiada con sus resultados.
18. Todo estudio de investigación médica que involucre a seres humanos debe ser precedido por una minuciosa evaluación de los riesgos y efectos colaterales previstos para los individuos o las comunidades que participan en la investigación, en comparación con los beneficios previsibles para ellos y para otros individuos o comunidades afectados por la enfermedad en estudio.
19. Se debe ingresar y registrar todo estudio clínico en una base de datos de dominio público antes de reclutar el primer paciente.
20. Los médicos no pueden participar en un estudio de investigación en seres humanos a menos que tengan plena convicción de que los riesgos inherentes han sido adecuadamente evaluados y de que pueden ser manejados de manera satisfactoria. Los médicos deben suspender inmediatamente un estudio en curso si perciben que los riesgos que acarrea superan los beneficios esperados o cuando existen pruebas concluyentes de resultados positivos o beneficiosos.
21. La investigación médica en seres humanos sólo podrá llevarse a cabo cuando la importancia del objetivo es mayor que los riesgos inherentes y los efectos colaterales que acarrea para los sujetos que participan de la investigación.
22. La participación de personas competentes como sujetos que participan en una investigación médica debe ser voluntaria. Aunque sea conveniente consultar a familiares o líderes de la comunidad, ninguna persona competente puede ser enrolada en un estudio de investigación a menos que acepte participar libre y voluntariamente.
23. Se deben tomar todas las precauciones para proteger la privacidad de los sujetos participantes en una investigación y la confidencialidad de sus datos personales y para minimizar el impacto del estudio en su integridad física, mental y social.
24. En la investigación médica en seres humanos competentes, cada sujeto potencial debe ser debidamente informado acerca de los objetivos, los métodos, las fuentes de financiamiento, cualquier posible conflicto de intereses, las afiliaciones institucionales del investigador, los beneficios anticipados y riesgos e inconvenientes previsibles del estudio y las molestias que pudiera ocasionar, y cualquier otro aspecto relevante del estudio de investigación. El sujeto potencial debe ser informado de su derecho de negarse a participar en el estudio o de retirar en cualquier momento su consentimiento para participar en él, sin que medie represalia. Se prestará especial atención a las necesidades específicas de información de cada individuo potencial como también a los métodos utilizados para transmitir la información. Luego de asegurarse de que el sujeto potencial ha comprendido la información, el médico u otra persona debidamente calificada debe procurar obtener entonces, preferentemente por escrito, el consentimiento informado otorgado libre y voluntariamente por el sujeto potencial. Si el consentimiento no pudiera otorgarse por escrito, el proceso para obtener el consentimiento no escrito se documentará y atestiguará formalmente.
25. En el caso de investigación médica en que se utilice material o datos humanos identificables, los médicos deben pedir normalmente el consentimiento para la recolección, el análisis y el almacenamiento y/o reutilización de las muestras. Pueden darse situaciones en las que sería imposible o impracticable obtener el consentimiento para dicha investigación o bien presentaría una amenaza a la validez de la investigación. En esos casos, la investigación podrá realizarse solamente luego de someterla a la consideración y la aprobación de un comité de ética en investigación.
26. Cuando se procura obtener el consentimiento informado para la participación en el estudio de investigación, el médico debe obrar con especial cautela cuando el sujeto potencial está vinculado a él en virtud de una relación de dependencia o si otorga su consentimiento bajo presión o amenazas. En esas situaciones, quien debe pedir el consentimiento informado es una persona debidamente calificada, completamente ajena a aquella relación.
27. Cuando el sujeto potencial que participa de una investigación es un incapaz, el médico debe pedir el consentimiento informado a su representante legal. Estas personas no deben ser incluidas en un estudio de investigación que no tiene probabilidades de aportarles beneficios, a menos que tenga por objeto promover la salud de la población representada por el potencial sujeto, que la investigación no pueda ser realizada con personas competentes y la investigación implique sólo riesgos y efectos colaterales mínimos.
28. Cuando un sujeto potencial considerado incompetente tiene la capacidad de asentir a la decisión de participar o no en un estudio de investigación, el médico debe pedir ese consentimiento, además del consentimiento de su representante legal. La negativa de otorgar el consentimiento del sujeto potencial debe ser respetada.
29. La investigación que involucra sujetos que tienen alguna incapacidad física o mental para otorgar el consentimiento, por ejemplo los pacientes que no están conscientes, solo podrá llevarse a cabo si la condición física o mental que impide otorgar el consentimiento informado es una característica necesaria de la población de la investigación. En esas circunstancias, el médico debe obtener el consentimiento informado del representante legal. Si dicho representante no está disponible y si no se puede retrasar la investigación, el estudio podrá proseguir sin consentimiento informado siempre que las razones específicas para incluir a sujetos con una enfermedad que les impide otorgar el consentimiento informado hayan sido estipuladas en el protocolo de investigación y el estudio haya sido aprobado por un comité de ética en investigación. El consentimiento para permanecer en el estudio debe obtenerse a la brevedad posible del sujeto o de su representante legal.
30. Los autores, directores y editores todos tienen obligaciones éticas con respecto a la publicación de los resultados de la investigación. Los autores tienen el deber de hacer públicos los resultados de su investigación con seres humanos y son responsables de que sus informes estén completos y sean exactos. Deben cumplir las normas éticas aceptadas para el reporte de datos. Se deben publicar o de algún otro modo poner en el dominio público los resultados negativos y no concluyentes así como los resultados positivos. En la publicación se deben citar las fuentes de financiamiento, las afiliaciones institucionales y los conflictos de intereses. Los informes de investigación que no se ajusten a los principios descriptos en esta Declaración no deben ser aceptados para su publicación.
C. PRINCIPIOS ADICIONALES APLICABLES CUANDO LA INVESTIGACION MÉDICA SE COMBINA CON LA ATENCIÓN MÉDICA
31. El médico podrá combinar la investigación médica con la atención médica sólo en la medida en que la investigación esté justificada por su potencial valor profiláctico, diagnóstico o terapéutico y si el médico tiene buenas razones para creer que la participación en el estudio de investigación no afectará de manera adversa la salud de los pacientes que se desempeñan como sujetos de investigación.
32. Los posibles beneficios, riesgos, efectos colaterales y efectividad de un nuevo procedimiento intervencionista deben ser evaluados mediante su comparación con los del mejor procedimiento intervencionista comprobado existente, excepto en las siguientes circunstancias:
• El uso de un placebo, o la ausencia de tratamiento, es aceptable en estudios donde no existe actualmente un procedimiento intervencionista comprobado; o
• En los casos en que por razones metodológicas convincentes y científicamente sólidas el uso de un placebo es necesario para determinar la eficacia o seguridad de un procedimiento intervencionista y los pacientes que reciben un placebo o no reciben ningún tratamiento no serán sometidos a ningún riesgo de daño grave o irreversible. Se debe tener sumo cuidado para evitar abusar de esta opción.
33. Al finalizar el estudio, los pacientes ingresados al estudio tendrán derecho a ser informados sobre el resultado del estudio y a compartir todos los beneficios resultantes del mismo, tales como el acceso a procedimientos intervencionistas identificados como beneficiosos en el estudio o bien a otra atención médica adecuada u otros beneficios.
34. El médico debe informar detalladamente al paciente sobre los aspectos de la atención médica que estén relacionados con la investigación. La negativa del paciente a participar en el estudio o la decisión del paciente de retirarse del estudio no debe interferir en ningún caso en la relación médico-paciente.
35. En la medida de lo posible, estos procedimientos deben convertirse en el objeto de la investigación, diseñada para evaluar su seguridad y eficacia. En todos los casos, se debe registrar y, cuando corresponda, poner a disposición del público, toda información nueva.
