Source text - Polish W celu ochrony wzajemnie przekazywanych informacji o charakterze poufnym Strony zawierają niniejsze porozumienie o obowiązku zachowania w tajemnicy wszelkich informacji o charakterze poufnym.
1.Informacje poufne oznaczają wszelkie informacje przekazane drugiej Stronie w jakiejkolwiek formie w zakresie: danych technicznych, know-how, programów komputerowych, specyfikacji produktów, procesów produkcyjnych, wynalazków i projektów wynalazczych, informacji ekonomiczno-finansowych, marketingowych i sprzedażowych, bazy klientów, wewnętrznych notatek i korespondencji, o ile:
a)nie są już w posiadaniu drugiej strony w dniu podpisania niniejszego porozumienia,
b)nie zostały w sposób uprawniony otrzymane od drugiej Strony lub osoby trzeciej bez zastrzeżeń dotyczących poufności,
c)mogą stanowić tajemnicę przedsiębiorstwa w rozumieniu przepisów o zwalczaniu nieuczciwej konkurencji.
2.Każda ze stron zobowiązuje się:
a) do użycia otrzymanych informacji poufnych jedynie dla celów, dla których zostaną przekazane;
b) nie ujawnić otrzymanych informacji osobom trzecim;
c) podjąć wszelkie niezbędne kroki w celu ochrony informacji poufnych drugiej Strony, w co najmniej taki sposób, jak w celu ochrony własnych informacji poufnych,
d) nałożyć na swoich pracowników odpowiedni obowiązek zachowania informacji
w tajemnicy.
3.Każda ze Stron zwróci otrzymane informacje poufne niezwłocznie na żądanie drugiej strony, jednak nie później niż po wygaśnięciu nin. Porozumienia.
4.Strona pokrzywdzona w wyniku wyjawienia informacji, będących jej własnością,
z powodu zaniedbania lub złej woli innej ze stron albo używania tych informacji wbrew postanowieniom punktu 2 może żądać odszkodowania za szkody poniesione z tego tytułu na zasadach ogólnych.
Translation - English In order to protect mutually exchanged confidential information, the Parties hereby agree to keep secret all information deemed as confidential.
1.Confidential information means all information given to the other Party in any form within the following scope: technical data, know-how, computer software, product specifications, production processes, inventions and invention designs, economic and financial data, marketing and sales information, customer database, internal notes and correspondence, provided that:
a) the information is not already owned by the other Party at the time of signing this agreement,
b) the information has not been rightfully provided by the other Party or any third party without reservation as to its confidentiality,
c) the information may constitute a company secret within the scope of the law prohibiting unfair competition.
2.Each Party shall:
a) use the information provided by the other Party only for the purposes that it was provided for;
b) not disclose the information to any third parties;
c) undertake all measures necessary to protect the confidential information of the other Party, using at least the same effort it uses to protect similar proprietary information of its own,
d) oblige its employees to properly keep the information secret.
3.Each Party shall return the received confidential information immediately upon a request of the other Party, no later than the termination of this agreement.
4.The party injured as the consequence of disclosure of such proprietary information of its own due to negligence or intentional acts of the other Party, or by use of proprietary information against the stipulations of article 2 above, shall seek damages for the losses thus incurred on general terms.

Korespondencja
1.Wszelkie zawiadomienia, oświadczenia, wezwania oraz inna korespondencja, przekazywane w związku z Listem, będą przez Strony doręczane pod adresy Stron wskazane w Liście, przesyłką poleconą lub kurierską albo osobiście i za potwierdzeniem odbioru, chyba że druga Strona wskaże na piśmie inny adres do doręczeń. Strony dopuszczają możliwość przekazywania sobie wszelkiej korespondencji za pośrednictwem faksu lub poczty elektronicznej, jednakże powołanie się przez którąkolwiek ze Stron na fakt doręczenia pisma drugiej Stronie będzie skuteczne pod warunkiem otrzymania zwrotnego poświadczenia odbioru podpisanego przez osobę umocowaną do reprezentowania Strony.
2.Pismo wysłane zgodnie z ust. 1 zdanie pierwsze niniejszego paragrafu uważa się za skutecznie doręczone w dniu wskazanym w zwrotnym potwierdzeniu odbioru przesyłki poleconej lub kurierskiej albo pisemnym potwierdzeniu osobistego doręczenia pisma.

Correspondence
1.All notices, statements, requests and other correspondence, submitted in connection with the letter shall be posted by the Parties to the addresses indicated in the Letter, by registered mail, or courier, or in person, unless the other Party designates in writing another address for the delivery. Parties allow for the possibility of transmission of all communications by facsimile or e-mail, however, any reference to the delivery of such communication to the other Party shall be effective subject to the reception of a return receipt signed by the person duly authorized to represent the Party.
2.Letter sent in accordance with paragraph 1 of this article shall be deemed effectively delivered on the date indicated in the return receipt of registered mail or courier or personal delivery with a written letter of confirmation.
