Source text - German Erbrechtsverordnung (EuErbVO) Art. 34 I enthält eine ungewöhnliche Regelung zur Frage der Rückverweisung. Anders als in anderen EU-VOen zum IPR wird nicht pauschal die Rückverweisung ausgeschlossen (also generell eine Sachnormverweisung ausgesprochen), sondern für bestimmte Fallkonstellationen (nämlich die in Art. 34 I genannten) die Beachtung einer Rück- oder Weiterverweisung (also eine Gesamtverweisung) vorgeschrieben.
Art. 34 I gilt von vornherein nur dann, wenn auf das Recht eines „Drittstaates“ verwiesen wird; Drittstaaten sind alle Nicht-EU-Staaten, sowie das Vereinigte Königreich, Irland und Dänemark, welche nicht an dieser VO teilnehmen (vgl. EG
82, 83).
Wird hingegen auf das Recht eines Mitgliedstaats verwiesen, sind Rück- und Weiterverweisung ausgeschlossen, handelt es sich also um eine Sachnormverweisung.
Dies wird in der VO zwar nicht ausdrücklich gesagt, lässt sich jedoch dem Charakter des Art. 34 als Ausnahmevorschrift entnehmen.
Wenn auf das Recht eines Drittstaates verwiesen wird, nennt Art. 34 I zwei Fälle, in denen die Rück- bzw. Weiterverweisung (oder auch: der sog. „Renvoi“) beachtlich sind: nämlich dann, wenn auf das Recht eines Mitgliedstaates (lit. a) oder auf das Recht eines Drittstaates, der sein eigenes Recht anwenden würde
(lit. b), rück- bzw. weiterverwiesen wird.
Diese Regelungstechnik hat zur Konsequenz, dass man in der Prüfung zunächst einmal hypothetisch ermitteln muss, welches Recht letztlich bei Annahme einer Gesamtverweisung zur Anwendung käme (also, „wohin“ das IPR des eigentlich berufenen Staats verweisen würde) – hypothetische Prüfung einer Gesamtverweisung. Wäre dies das Recht eines der in lit. a oder lit. b beschriebenen Staaten, würde die eben geprüfte Gesamtverweisung verbindlich – das betreffende Recht würde gelten.
Wäre dies hingegen nicht das Recht eines der in lit. a oder lit. b beschriebenen Staaten, bliebe das IPR des in der eigentlichen Kollisionsnorm berufenen Rechts außer Acht und es würden dessen Sachnormen gelten (d.h.: Sachnormverweisung).
Translation - English Article 34, Sec. 1 of the European Inheritance Law Ordinance (EuErbVO) contains an unusual rule as to the process of Renvoi. Contrary to other European Conflict of Laws (CL) Regulations, referral back is not rejected as a matter of course (i.e. pointing to substantive law instead), but in certain cases (those specified in Article 34, Sec. 1) referral back or further referral (in other words a Renvoi) is actually mandated.
The application of Article 34, Sec. 1 is limited to referrals to ‘’third country’’ rights; Third countries (Drittstaaten) include all non-EU States, as well as the United Kingdom, Ireland and Denmark, which do not participate in this regulation (see EG 82, 83).
However, if referral is made to the law of a Member State, back and further referrals are precluded, in other words it is a referral to substantive rules.
This is actually not expressly stated in the regulation, but can be derived from the character of Article 34 as a regulation of exceptions.
When reference is made to the laws of a third country, Article 34, Sec. 1, lists two cases in which referral back or further referral (i.e. "Renvoi") are noteworthy: namely, in cases where a referral is to the right of a Member State (Sec.1(a)) or to a third country that would apply its own laws. (Sec.1(b)).
This regulatory technique has the consequence that any examination must first determine hypothetically which right would ultimately be applied if a Renvoi were to be accepted (i.e., to "where" the CL rules of the state actually relied on would point) - Hypothetical examination of a Renvoi. If this right is the right of one of the States described in Sec. 1(a) or Sec. 1(b), the just examined Renvoi would apply - the relevant law would apply.
However, if referral is not the right of one of the Sec. 1(a) or Sec. 1(b) described States, the CL Rules of the referred jurisdiction would be ignored and its substantive law would apply (i.e.referral to Substantive law).
