This Lease Agreement is made on the between:

as a care-taker for the leased apartment who is hereinafter referred as the LANDLORD, who, in accordance with the attached document, has the power of Attorney to rent, receive the rent payments and deals any matter concerning the lease of the thereunder mentioned premises
and
hereinafter referred as the LEASSEE.
The preamble is an integral and biding part of this Agreement. The Contract is subject to the presentation of all documents of registration of ownership.
By signing the Agreement, the LANDLORD duly confirms to be entitled to lease the premises thereunder mentioned.
Article 1 Object of Contract

Article 3 Terms of payment
The yearly rent mutually agreed and payable by the Lessee to the Landlord on consideration of the lease and all rights hereinafter conferred up on the Lessee shall be ( ……… USD ) …………………………………….. U.S dollars.
1st payment is 1 year in advance then will be on 3 months in advance payment base. ( this amount of rent includes all services ).
Article 4 Early termination
The LESSEE has the right to terminate the contract at any time during the lease period for his/her own reasons upon 60 days notice.
The LANDLORD shall retain rent payments paid in advance by the LESSEE up to the date of the new termination. The LANDLORD shall refund the payments made by the lessee covering the period when the LESSEE is not anymore in possession of the premises.
The LESSEE agrees to make the premises available for viewing by prospective tenants during the aforementioned two months notice period.
Article 5 Obligations of the LESSEE
1 From the date on which the lease takes effect up to the date on which it is terminated, the LESSEE shall take over, in its own name, the subscriptions to water and electricity and shall regularly settle the bills pertaining thereto. The LESSEE shall in no circumstances be held liable for any amounts due prior to the period covered by the present lease. The meters and other measuring equipment for the billing of services shall be read by the relevant companies.
If water and electricity meters are shared between the lessee and other tenants, cost of the bill will be shared according to number of units in the building.
2 Municipality taxes connected with the occupation of the premises shall be the expense of the LESSEE.
3 The premises leased shall be used to the goals and obligations of the International-Committee of the Red Cross. The LESSEE may not sub-let the premises or assign its rights under the lease to any third party without prior written consent of the LANDLORD.
4 Any charge, transformation or new construction of a permanent nature shall require the prior written consent of the LANDLORD.
5 The LESSEE shall have the right to erect antenna and VHF/HF radio, signs to indicate the ICRC in public hallway and outside of the leased premises.
6 The LESSEE shall have the right to use the common areas, such as, gardens, parking area, hallway, stairs, etc…
7 The LESSEE shall have the right to use an existing telephone lines and the right to install additional lines as needed.
8 The LESSEE shall use the premises with care and is obliged to maintain them in good condition “normal wear and tear”. Minor maintenance and cleaning work shall be at the expense of the LESSEE.
9 The LESSEE shall return premises in the condition in which it received them by the date of expiry of the lease at latest, normal wear and tear expected.
Article 6 Obligation of the LANDLORD
1 Any property tax, contribution, fee or charge (except municipal taxes) imposed or to be imposed by any authority whatsoever on the premises leased shall be the responsibility of the LANDLORD solely.
2 The object of the lease shall be rented exclusively to the LESSEE for the period stipulated in the present lease.
3 The LANDLORD is further responsible for the repairs and renovation arising from normal wear and tear, from dilapidation of the building or from faults in construction. This includes, for example, walls, roof, drains, septic tanks, cesspool, plumbing, sanitary, ware, etc…
Should the LANDLORD fail to carry out such repair within a reasonable time, after notification by the LESSEE, the LESSEE may order the necessary repairs and be reimbursed for his reasonable expenses by the LANDLORD upon presentation of the repair invoices, or deduct his expenses from rent due.
4 Furthermore, the LANDLORD is responsible for risks of fire, water, natural catastrophes, earthquakes, war and internal trouble.
Article 7 Insurance
The LANDLORD shall take out an insurance policy to cover the third party liability he assumes under the present lease.
The LESSEE shall be liable only for such damage as it may cause to the building through negligence or his own fault.
The LESSEE shall be refrain from storing in the premises leased any goods which might be dangerous from the point of view of fire or explosion or which, for any reason whatsoever, might cause an increase in the insurance premises paid by the LANDLORD.
Article 8 Miscellaneous
1 The LANDLORD may enter the premises after due co-ordination with the LESSEE to examine the premises.
2 Any amendment to the articles here-above must be made in writing, signed by the two parties and annexed to the present lease.
3 Any communication or notification between the parties must be delivered by hand or sent by registered letter. Registered mail is deemed to be received three days after it is mailed.
4 In the event that the lessee ceases or reduces its activities in the autonomous authorities following instructions from its main office in Geneva, this agreement shall be considered void for the reminder of the lessee period on the condition that the lessee serves prior notice to the lessor at least 60 days in advance and the lessor will be obliged to return the lessee the rent which was paid for the period after the 60 days notice.
5 Any dispute arising out of this contract or out of the tenancy relationship between the parties that cannot be amicably resolved shall be referred to binding arbitration under local law whereby both parties agree to a single arbitration, or if they fail, each party will appoint an arbitrator and the two arbitrators will appoint an umpire whose decisions shall be binding on both parties.

كقيم / حارس على الشقة المؤجرة/العين المؤجرةوالمذكور فيما بعد (المالك) والذي بموجب المستندات المرفقه/الملحقة موكلاً بأن يؤجر ويستلم الإيجارات و يسير أي أمور تتعلق بالإيجار، والمذكور فيما يلي (المبنى).
و السيد/ فلان فلان، والمذكور فيما بعد (المستأجر).
المقدمة/ التمهيد جزء مكمل ولا يتجزأ من العقد. العقد هو عرضة لتقديم كل مستندات توثيق/تصديق الملكية. بتوقيع هذا الإتفاق يؤكد المالك، وحسب الأصول، على إيجار المبنى المذكرورة فيما يلي.

مادة 3 شروط دفع الإيجار

يقوم المستأجر بدفع بدل سنة مقدماً كدفعة، ثم يتم الدفع مقدماً كل ثلاثة شهور (يتضمن هذا المبلغ جميع الخدمات)
مادة 4 إنهاء/فسخ العقد
يحق للمستأجر فسخ العقد في أي وقت خلال فترة التعاقد لأسباب خاصة، على أن يقدم إشعار مسبق قبل 60 يوم.
للمالك الحق في الإحتفاظ بمقدم الإيجار المدفوع عن فترة الإيجار الفعلية حتى تاريخ فسخ العقد. وعلى المالك أن يعيد ما دفعه المستأجر عن الفترة التي فيها تكون العين المؤجرة ليست في حيازة المستأجر.
وافق المستأجر على أن يكون العقار متاحاً للمعاينة أمام المستأجرين الجدد خلال فترة شهري الإشعار المذكورة.
مادة 5 التزامات المستأجر
1 من تاريخ سريان العقد وحتى تاريخ إنهاؤه، يتولي المستأجر، وباسمه، تسديد اشتراكات الماء والكهرباء، ويدفع بإنتظام الفواتير الخاصة بها. لا يتحمل المستأجر تحت أي ظرف مسئولية أي مستحقات عن فترات لا تغطيها فترة الإيجار الحالية. العدادات وأدوات القياس الأخرى لفواتير الخدمات يتم قراءتها من قبل الشركات ذات العلاقة/المخولة بذلك.
وفي حال إشتراك عدة مستأجرين في عداد مشترك، فإن تكلفة الفاتورة تدفع كل تبعاً لعدد الوحدات المستهلكة.
2 يقوم المستأجر بدفع ضريبة الأملاك للبلدية، والمتعلقة باستعمال المبنى.
3 يستخدم العقار المؤجر لأغراض والتزامات اللجنة الدولية للصليب الأحمر. ولا يحق للمستأجر أن يؤجر العقار من الباطن أو يخول حقوق الإيجار لأي طرف ثالث بدون موافقة كتابية مسبقة من المالك.
4 لا بد لأي تغيير أو نقل أو إنشاء جديد ذو طبيعة دائمة الحصول على موافقة مسبقة من المالك.
5 يحق للمستأجر نصب/تركيب هوائي بموجات راديو عالية التردد أو ذات تردد عالي للغاية، وأيضاً وضع لافتات تشير إلى اللجنة الدولية للصليب الأحمر في المدخل العام وخارج العقار المؤجر.
6 يحق للمستأجر إستخدام الأماكن العامة، مثل الحدائق والكراجات والمداخل والسلالم الخ.....
7 للمستأجر الحق في إستخدام خطوط الهاتف الموجودة وتركيب خطوط هاتف جديدة عند الحاجة.
8 يحق للمستأجر إستخدام العقار بعناية، وهو ملزم بالحفاظ علية بحالة جيدة (التلف الطبيعي الناتج عن الإستخدام). وتكون تكاليف أعمال الإصلاح والتنظيف الثانوية على المستأجر.
9 على المستأجر أن يسلم العقار على نفس الحالة التي إستلمه بها، وبأقل إهلاك ناتج، بمجرد إنتهاء مدة الإيجار.
مادة 6 إلتزامات المالك
1 أي رسوم أو إشتراكات عقارية أو رسوم أو أموال (فيما عدا رسوم البلدية) مفروضة أو ستفرض على العقار من قبل أي سلطة تكون من مسئولية المالك وحده دون غيره.
2 تؤجر العين موضوع الإيجار فقط وحصرياُ للمستأجر للفترة المقررة في عقد الإيجار الحالي.
3 يكون المالك هو المسئول عن أي إصلاحات أو ترميمات تنشأ عن التلف العادي الناتج عن الإستخدام أو تقادم المبني أو عن أخطاء في البناء. ويشمل ذلك، علي سبيل المثال، الحوائط والسطح و التسريب وتلوثمصارف المياه صهاريج الصرف الصحي والسباكة و الأدوات الصحية...الخ
إذا عجز المالك عن القيام بالإصلاحات خلال فترة معقولة من الإشعار الذي تلقاه من المستأجر، فإنة يحق للمستأجر أن يطلب تعويضاً من المالك عن تكاليف الإصلاحات الضرورية اللازمة التي قام بها بعد تقديم فواتير الأصلاحات ،أو خصم قيمتها من مبلغ الإيجار.
4 بالإضافة لذلك، يكون المالك هو المسئول عن مخاطر الحريق والمياة و الكوارث الطبيعية والزلازل والحروب والإضطرابات الداخلية.
مادة 7 التأمين
على المالك أن يقوم بعمل بوليصة تأمين تغطي الطرف الثالث يتولاها بموجب العقد الحالي
يكون المستأجر مسئولاً فقط عن الأضرار التي قد تحدث للمبنى نتيجة إهمال أو خطأ شخصي منه.
يمنع المستأجر من تخزين أي مواد ملتهبة خطرة بالعقار من شأنها أن تمثل خطراً يؤدي لحريق أو إنفجار، أو تؤدي لأي سبب كان في زيادة قسط التأمين المدفوع من قبل المالك.
مادة 8 متفرقات
1 يجوز للمالك دخول العقار بالتسيق المسبق/بصحبة المستأجر بغرض تفقد العقار.
2 لا بد لأي تعديلات على ماذكر سابقاً أن تكون مكتوبة وموقعة من قبل الطرفين وملحقة بالعقد الحالي.
3 لا بد لأي إتصال أو تنبيه يتم فيما بين طرفي العقد أن يسلم باليد أو بخطاب مسجل. البريد المسجل يعد مستقبلاً بعد ثلاثة أيم من تاريخ إرسالة.
4 في حال أوقف المستأجر فعالياته بالقطاع أو خفض منها بناءً على تعليمات من المركز الرئيسي في جنيف فإن العقد يعد لاغياً بشرط أن يتقدم المستأجر بإشعار مسبق قبل 60 يوماً، ويكون المالك ملزماً بإعادة مبلغ الإيجار عن فترة ما بعد إنتهاء مدة الإشعار.
5 أي خلاف ينشأ بسبب العقد أو الإيجار، بحيث لا يمكن حلة بشكل ودي، يتم الرجوع للقضاء المحلي الذي بمقتضاه يوافق الطرفان على إختيار محكماً واحداً أو يعين كلاهما محكماً، ثم يقوم المحكمان بتعيين ثالث تكون قراراته ملزمة لكلا الطرفين.
