Aus einem Artikel über M&A Schiedsgerichtsverfahren:

Die kurzfristige Erhebung einer Schieds(feststellungs-)klage zur Verjährungshemmung ist nur bei institutionellen Schiedsverfahren wie etwa nach dem DIS Verfahrensrecht problemlos möglich. Denn bei Ad hoc Schiedsverfahren gibt es im Zeitpunkt der Verfahrenseinleitung noch kein Schiedsgericht, das die Klage entgegennehmen könnte. Ein solches müsste sich zuvor erst konsti-tuieren.

Um dieser Schwierigkeit für den Kläger zu ***begegnen***, tritt nach deutschem materiellem Recht eine Verjährungshemmung gem. § 204 Abs. 1 Nr. 11 BGB schon mit dem Beginn des schiedsrichterli-chen Verfahrens gem. § 1044 ZPO ein. Danach beginnt das schiedsrichterliche Verfahren mit dem Tag, an dem der Beklagte den Antrag empfangen hat, die Streitigkeit einem Schiedsgericht vorzu-legen. Dieser Antrag muss gem. § 1044 ZPO die Bezeichnung der Parteien, die Angabe des Streit-gegenstandes und einen Hinweis auf die Schiedsvereinbarung enthalten. Nicht erforderlich ist die Darlegung der den Anspruch begründenden Tatsachen.

Die Schwierigkeit, von der hier die Rede ist, besteht allein in dem Umstand, dass ad hoc kein Schiedsgericht existiert, also eine f. den Kläger ungünstige Situation, die durch eine entsprechende gesetzliche Vorschrift ausgeglichen werden soll.
