From the operative part of an Italian Judgement:
"il Tribunale dichiara non doversi procedere nei confronti di... per essere i reati estinti per maturata prescrizione."
I can only think of "declares not to proceed," but then I wonder how to express the difference with "non luogo a procedere".

Better post 'non luogo a procedere' as a separate question, but the French equivalent of a non-lieu can mean enter or entry of a nolle prosequi.

Thank you. Actually, for the time being, I am just interested in "non doversi procedere". I just mentioned "non luogo a procedere" as I realized that there is a difference between the two situations, although they may sound similar to someone who does not have a legal background. |

mi scuso, ho annullato la mia risposta perché *non-suit* è un termine ora obsoleto e riguardava anche cause civili per cui non pertinente.
Agree with Adrian for his option *nolle prosequi* as an alternative to your own translation or to *declares not to prosecute*.
