Italian term

atto di citazione introduttivo

Italian to English Law/Patents Law (general)
From a legal brief:

"per espressa affermazione della difesa avversaria nell’atto di citazione introduttivo del presente giudizio, ..."

I generally use either (writ of) summons or subpoena for "atto di citazione". But what would be the English for that "introduttivo"? As a context, the adverse Party here is the Claimant of a civil case.

originating process

"originating process" means the process by which proceedings are commenced, and includes the process by which a cross-claim is made.

agree Adrian MM. (X) : you beat me to it. I was wavering/(Scots) havering between originating application and summons (construction = interpretation of doc. query/queries only)
