Forgoing means going without. Foregoing means what has gone before, in this case the part of the document before this sentence.

Thank you, Robert - I just addressed that - they are both correct spellings, but Jack's is superior unless the asker was directed to use the word minus the 'e'

Thank you, cmwilliams; I have contracts in my posession written exactly as the asker states, but no URL validation - I don't believe she is asking which sp., I think she is asking if the word 'forgoing' is placed correctly in the sentence.
