C'est ainsi que l'on pourrait traduire "occulte" dans un contexte ordinaire. J'en suis moins sûr en ce qui concerne une hypothèque. Je comprends ici que les hypothèques, même de droit public, peuvent ne pas être rendues publiques et rejoindre dans leur confidentialité les hypothèques notariées relevant du droit privé.
"Les hypothèques sont occultes. L’acquéreur d'un immeuble peut faire pratiquer un décret volontaire qui lui permet de connaître la véritable situation de l’immeuble acquis."
