agree RobinB : The cited section 179 of the BGB refers to "der andere Teil" ("Gschäftsgegner" doesn't occur at all in the BGB), and the BGB translation on the BMJ website (now pulled under mysterious circumstances) uses "other party".

This would be my preference; since "BGB 164" and BGB 179" both appear to relate largely to liabilities under civil law burden of proof and legal actions, and they all relate to arguments of one sort or another. I think it needs to bring out the "opposition" element as does the German.
