Source text - English This is the hearing of the Claimant's claim for judicial review in respect of the Defendant's award of a contract for the provision of focus group and communications support services ("the Contract") without public notice or competition, relying on Regulation 32(2)(c) of the Public Contracts Regulations 2015 ("the PCR 2015").
The award of the Contract to the Interested Party ("Public First") was made by the Defendant's letter dated 5 June 2020 and an email from Public First dated 8 June 2020, with an effective date of 3 March 2020 and an expiry date of 2 September 2020.
The services and deliverables under the Contract included:
i) recruitment and delivery of focus groups and/or mini groups to an agreed specification, covering the general public and key sub-groups defined by demographic, life stage or other agreed criteria;
ii) same-day top line reporting and next-day fuller reporting of focus group findings; and
iii) on-site resource to support Number 10 Communications.
The grounds of challenge relied on by the Claimant are as follows:
i) Ground 1: there was no basis for making a direct award under Regulation 32(2)(c). The Claimant's case is that the direct award of the Contract to Public First was not strictly necessary. The Government already had several existing contracts with other suppliers which it could have used to commission the work; alternatively the duration of the Contract and services commissioned under the Contract should have been restricted to a few weeks, enough time to meet the Defendant's needs, while it conducted a competitive procurement of the services.
ii) Ground 2: the award of the Contract for a period of six months was disproportionate. The Claimant's case is that even if Regulation 32 were applicable, the Contract should have been restricted to the Defendant's immediate, short term needs, pending a competitive process to procure a longer term supply of the services.
iii) Ground 3: the decision to award the Contract to Public First gave rise to apparent bias contrary to principles of public law. The Claimant's case is that the fair minded and informed observer would conclude that there was a real possibility of bias, having regard to the personal connections between the decision-makers and the directors of Public First.
Translation - Czech Toto je slyšení ve věci požadavku navrhovatele na soudní přezkoumání odpůrcova zadání veřejné zakázky na poskytování průzkumu pomocí fokusních skupin a komunikačních služeb (dále jen „zakázka“) bez veřejného oznámení či výběrového řízení, realizované podle předpisu 32(2)(c) zákonu Public Contracts Regulations 2015
Uzavření smlouvy se zainteresovanou stranou (Public First) bylo stvrzeno v dopise od odpůrce datovaném 5.6.2020 a emailu od Public First datovaném 8.6.2020. Smlouva nabyla účinnosti 3.3.2020 a vypršela 2.9.2020
Služby, kterých se smlouva týkala, zahrnovaly:
I. Sestavování fokusních skupin a/nebo malých fokusních skupin podle dohodnutých kritérií zahrnujících širší veřejnost a klíčové podskupiny vymezené demografií, věkem či jinými dohodnutými kritérii;
II. Dodání shrnutí výsledků průzkumu ještě týž den a podrobnější zprávy druhý den od provedení experimentu s fokusní skupinou.
III. Zajištění prostředků pro podporu komunikace Downing Street přímo na místě.
Navrhovatel podává žalobu založenou na následujících bodech:
I. První bod: Nebyla nutnost pro udělení zakázky bez výběrového řízení podle předpisu 32(2)
(c). Navrhovatel je toho názoru, že udělení zakázky společnosti Public First bez soutěže nebylo nezbytně nutné. Vláda již měla několik platných smluv s jinými dodavateli, které mohla využít k zadání projektu; případně měla omezit délku smlouvy a na jejím základě poskytovaných služeb na několik týdnů, což byl dostatečný čas na naplnění potřeb odpůrce, a během nich vypsat regulérní výběrové řízení k zajištění dlouhodobějšího poskytování služeb.
II. Druhý bod: Udělení zakázky na dobu šesti měsíců bylo nepřiměřené. Navrhovatel je toho názoru, že přestože byl důvod k uplatnění předpisu 32, zakázka měla být omezena na

bezprostřední požadavky odpůrce, zatímco by bylo vykonáno výběrové řízení k zajištění
dlouhodobějšího poskytování služeb.
III. Třetí bod: rozhodnutí udělit zakázku společnosti Public First zavdalo důvod k podezření z
podjatosti v rozporu s principy veřejného práva. Navrhovatel je toho názoru, že objektivní a informovaný pozorovatel musí dojít k závěru, že vzhledem k osobnímu vztahu mezi zadavateli a některými z členů správní rady Public First je zde důvod k podezření z podjatosti.

elbow. When it healed, and Jem’s fears of never being able to play football were
assuaged, he was seldom self-conscious about his injury. His left arm was
somewhat shorter than his right; when he stood or walked, the back of his hand
was at right angles to his body, his thumb parallel to his thigh. He couldn’t have
cared less, so long as he could pass and punt.
When enough years had gone by to enable us to look back on them, we
sometimes discussed the events leading to his accident. I maintain that the Ewells
started it all, but Jem, who was four years my senior, said it started long before
that. He said it began the summer Dill came to us, when Dill first gave us the idea
of making Boo Radley come out.
Translation - Czech Když mu bylo skoro třináct, zlomil si brácha Jem ošklivě ruku v lokti. Potom, co se mu zahojila, a obavy, že už nebude moci hrát fotbal byly zahnány, moc se tím už netrápil. Levou paži měl trochu kratší než pravou; když stál nebo šel, hřbet ruky měl v pravém úhlu k tělu, palec vodorovně ke stehnu. Ale když mohl přihrávat a vykopávat, bylo mu to fuk.
Když uplynulo dost let a my se občas dívali nazpátek, probírali jsme události, které k nehodě vedly. Já trvám na tom, že to všechno začali Ewellovi, ale Jem, který je o čtyři roky starší, říkal, že to začalo dávno předtím. Říkal, že to začalo to léto, co k nám přišel Dill a vnuknul nám nápad na vylákání Bubu Radleyho z domu.
