I. Spice Up Your Teaching
Enough already. Studies show it, professors know it: the Socratic Method is not enough. But to be fair to Socrates, any single teaching method is not enough. A combination of teaching methods that creates a variety of approaches is the most effective way to enhance law-school learning.
So we four law-school professors collaborated to create a go-to guide—a collection of 80 creative teaching ideas. We put each idea to the test in the classroom. Then we categorized them by skill, so it’s easy to find what you need when you need it. And now we share them with you—fellow law teachers who want to flavor their teaching with variety.
Keep this guide handy to quickly find a wide variety of class exercises. Or use it to spark your own ideas to teach your material more creatively. You’ll enjoy what variety can do for your eaching. And your students will thank you for it.
How We Cooked Up Variety
Our best teacher has been our experience, 38 years among the four of us. It’s taught us that students have a variety of learning styles, preferences, and work ethics so, we should use a variety of teaching methods to best capture their attention. We understand that different methods help develop the lawyering skills that practice demands. And we understand that by using various ways to convey information, we model tools that students will need to teach the law someday—to a client, juror, judge, or opposing counsel.
But what we didn’t understand was what to do about it in our classrooms each week. So we decided to collaborate. We met every Tuesday afternoon for an entire term to share our teaching ideas. And we held ourselves accountable. Every week, we each had to bring two new teaching ideas, in writing. Every week, after we shared our eight ideas, we challenged each other to try one shared idea in class. And every week, we did it. Then the next week, we reported on what happened.
And so it went for 13 weeks: four professors sharing eight new teaching ideas, reflecting on those tried the previous week, and choosing four more to try the next week.
The result? Eighty refreshing ideas.
To help you choose an idea or exercise that addresses a certain skill, we’ve listed the exercises by skill category. You’ll find this list at the end of the 80 descriptions, on page 86.
Exercises
1. Students Up Front
Presenting in front of the class gives students practice in public speaking. And having them present a review advances their understanding of the material.
For this exercise, start the class with a review of material covered in the previous session. But your students, not you, will lead it. And announce that you will select three other students at the end of class to lead the next review. Because all your students know that they could be presenting next, they have another incentive to pay close attention during class.

I. Modernizar las clases
¡Basta! Hay estudios que lo demostraron, los profesores lo saben: el método socrático ya no es suficiente pero, para ser justos con Sócrates, ningún método de enseñanza lo es. Al combinar distintos métodos de enseñanza se crean distintas formas de abordar el Derecho, y esta es la manera más eficiente de mejorar su aprendizaje en la facultad.
Somos cuatro profesoras de distintas Facultades de Derecho que colaboramos con el fin de crear esta guía de consulta: una colección de 80 ideas de enseñanza creativas. Pusimos en práctica cada idea en el aula, luego las clasificamos en distintas categorías para que sea fácil de encontrarlo cuando las necesiten, y ahora las compartimos con ustedes, colegas, profesores de Derecho que desean enriquecer sus clases haciéndolas más variadas.
Tengan esta guía a mano para encontrar de manera rápida distintos ejercicios para sus clases, o utilícenla para despertar ideas propias y así abordar el material de clase de manera más creativa. Al ponerla en práctica, podrán ver cómo la variedad puede contribuir al momento de enseñar, y sus estudiantes se lo agradecerán.
II. ¿Cómo creamos variedad?
Nuestro mejor profesor fue la experiencia, sumamos 38 años entre
las cuatro. Los años nos enseñaron que los estudiantes tienen maneras de aprender, preferencias y éticas laborales diferentes, por lo tanto, debemos usar varios métodos de enseñanza para captar mejor su atención. Entendemos que dichos métodos ayudan a desarrollar las habilidades para litigar que se requieren en la práctica profesional, como también entendemos que al emplear distintas maneras de transmitir la información, modelamos las herramientas que los estudiantes necesitarán algún día cuando tengan que transmitirle sus conocimientos sobre el Derecho a un cliente, jurado, juez o abogado de la contraparte.
Sin embargo, no sabíamos cómo llevar a cabo estas ideas en clase
semana a semana, entonces, decidimos ayudarnos entre nosotras. Nos comprometimos a juntarnos cada martes a la tarde durante un cuatrimestre para compartir nuestras ideas de enseñanza, y cada una tenía que llevar por escrito dos actividades nuevas para implementar en el aula. Luego de exponer las ocho ideas, nos desafiábamos a probar una en clase. A la semana siguiente, comentábamos entre nosotras cómo se había desarrollado la clase.
Y así lo hicimos durante 13 semanas. Cuatro profesoras compartíamos ocho ideas nuevas, reflexionábamos sobre la que pusimos en práctica la semana anterior y elegíamos cuatro más para poner a prueba la semana siguiente.
¿Cuál fue el resultado? 80 ideas innovadoras.
Para ayudarlos a elegir una idea o ejercicio que aborde alguna categoría en particular, enumeramos los ejercicios y los agrupamos por categoría. Encontrarán dicha lista al final de las 80 descripciones.
III. Ejercicios
1. Los estudiantes al frente
Dar presentaciones frente a los compañeros les otorga a los estudiantes la posibilidad de practicar cómo hablar en público. Además, mediante esta tarea, mejoran la comprensión de los textos utilizados.
Para este ejercicio, se recomienda iniciar la clase con un repaso de
los temas vistos la clase anterior, pero quienes llevarán a cabo esta tarea serán los estudiantes y no el profesor. Para ello, además, el profesor deberá elegir, al final de la clase, a otros tres estudiantes que estarán a cargo del próximo repaso. Como los estudiantes saben que podrían ser los próximos en dar la presentación, tendrán más incentivos para prestar atención en clase.

Legal education historically was based entirely on written text. Traditional casebooks were just that—edited copies of appellate cases with textual notes. Pictures in casebooks were so rare that they deserved protection under the Endangered Species Act. In class, law teachers wrote words on the board. In recent years, many have used technologies such as PowerPoint to facilitate
teaching, but the material projected on the screen was often more text. In our social world, however, the authority of the visual rivals that of written text. Today, all of us swim in a sea of images on television, on billboards, on computer screens, everywhere. Our students think visually. Legal education must keep pace.
A. THE USE OF VISUAL MATERIALS (INCLUDING POPULAR CULTURE) IN LAW SCHOOL COURSES
The first six articles in the symposium concern the use of visual imagery in teaching traditional law school classes. Elizabeth G. Porter’s article Imagining Law: Visual Thinking Across the Law School Curriculum is a good place to start. As law practice becomes increasingly multimodal, Porter argues, the use of visual
materials must be integrated into legal education. And she suggests some “low-friction, hands-on ways to incorporate a visual element into whatever course you teach.” Law teachers can show students legal documents, such as pleadings, that incorporate visual imagery. But the persuasive effect of layout, font, and other visual aspects of traditional words-only documents can be analyzed as well. Porter also suggests inviting students to practice spotting and analyzing the legal issues through images that capture legal concepts.
B. TEACHING LAW STUDENTS TO INTERPRET AND TO CREATE VISUAL MATERIALS
Six of the articles in the symposium offer perspectives on teaching law school courses in visual literacy. The courses described variously teach students how to interpret visual images and employ visual forms of storytelling, how to deploy visual rhetoric and create visual images for use in legal contexts, and how to both spot and avoid the mistakes of naïve realism.

Tradicionalmente, la enseñanza del Derecho se basó exclusivamente en el uso de textos escritos. Las colecciones de sentencias eran simplemente eso, copias editadas de sentencias apeladas con notas escritas. Las imágenes en dichas colecciones de sentencias eran tan raras que debían protegerse mediante la Ley de Protección de Especies en Peligro de Extinción. En las clases, los profesores escribían palabras en el pizarrón, a diferencia de hoy, que muchos han comenzado a utilizar herramientas tecnológicas, tales como Power Point, para facilitar la enseñanza en el aula y, sin embargo, el material que se proyecta generalmente muestra más texto. De cualquier manera, en nuestro mundo social, la fuerza de lo visual le gana a la fuerza del texto
escrito. Hoy, navegamos en un mar de imágenes presentes en la televisión, en los carteles, en las computadoras. Nuestros estudiantes piensan de manera visual y la enseñanza del Derecho debe mantener ese ritmo.
A. EL USO DE CONTENIDO VISUAL Y DE LA CULTURA POPULAR EN LAS FACULTADES DE DERECHO
Los primeros seis artículos del simposio hacen referencia al uso de la imaginería visual en la enseñanza del Derecho tradicional en la Facultad de Derecho. El artículo de Elizabeth G. Porter Imagining Law: Visual Thinking Across the Law School Curriculum (en español, Imaginando el Derecho: el pensamiento visual en todo el plan de estudios de la carrera de Derecho) es un buen punto de partida. Como la práctica legal se vuelve cada vez más multimodal, Porter sostiene que el uso de contenido visual debe
integrarse a la enseñanza del Derecho y sugiere “maneras prácticas y de poca fricción para incorporar un elemento visual a cualquier materia que se dicte”. Los profesores de Derecho pueden mostrarles a sus alumnos documentos legales que incluyan a la imaginería visual. Sin embargo, también pueden analizarse el efecto persuasivo del formato, de la tipografía y de otros aspectos visuales de documentos que tradicionalmente suelen contener solamente palabras. Asimismo, Porter propone darles lugar a los estudiantes para que puedan practicar localizar y analizar las
cuestiones legales a través de imágenes que capturan conceptos legales.
B. ENSEÑAR A LOS ESTUDIANTES DE DERECHO A INTERPRETAR Y CREAR CONTENIDO VISUAL
En seis de los artículos del simposio se ofrecen distintas perspectivas sobre la enseñanza de la alfabetización visual en facultades de derecho. En estas clases, se les enseña a los estudiantes, de diversas maneras, cómo interpretar imágenes
visuales, emplear distintas alternativas para relatar historias gráficamente, implementar la retórica visual, crear estas imágenes para utilizar en ámbitos jurídicos, así como identificar y evitar los errores del realismo ingenuo.
