إذا ما أسند الدستور تنظيم حق من الحقوق الى السلطة التشريعية فلا يجوز لها أن تسلب من اختصاصها وتحيل الأمر برمته الى السلطة التنفيذية دون أن تقيدها في ذلك بضوابط عامة وأسس رئيسية تلتزم بالعمل في اطارها فإذا ما خرج المشرع على ذلك وناط بالسلطة التنفيذية تنظيم الحق من أساسه كان متخليًا عن اختصاصه الأصيل | Translation - English
As long as the constitution has made the legislative authority organize a right, this authority may not give this right to the executive authority without limiting this right by public restrictions and main fundamentals the executive authority must abide by. As a result, if the legislator breaks that and makes the executive authority entirely organize this right, this right is given up by the legislator. |
