Az ingatlant törvényesen birtokló tulajdonosnak vagy bérlőnek az ingatlan folyamatos, az előző tulajdonos, bérlő vagy elsőbbségi jogokat követelő harmadik fél által meg nem zavart használatának a joga.

: Jogilag a használat és a haszonélvezet nem szinonímák, a használati jog szűkebb körű, pl. használati jog jogosultja csak természetes személy lehet. Ettől függetlenül, nem kizárt, hogy itt mégis a használatra gondoltak, ez esetben ez a jó válasz.
