Deutsch term

dies nicht zu vertreten haben

Deutsch > Englisch Rechts- und Patentwesen Immobilien/Grundstücke
This is a line from a rent agreement and I am a little confused about what way the above term should be translated:
"Sofern die Verzögerung in höherer Gewalt begründet liegt, hat der Bauherr dies nicht zu vertreten und schuldet keine Zahlung nach Satz 1"
Proposed translations (Englisch)
4 +4 shall not be liable for it
3 is to be held unaccountable for this

Deutsch term (edited): dies nicht zu vertreten

is to be held unaccountable for this

It's really a tautology: the höhere Gewalt as the force majeure cause of the hold-up is beyond the building client's control/nicht zu vertreten anyway. So there's little point adding it.

Example sentence:

Bank Held Unaccountable for Loss from Voice Phishing. A local court has exonerated a bank from compensating a customer who fell victim to a voice phishing ...
