Der Gefahrtarif ermöglicht es, bei der Beitragsberechnung die Beiträge nach dem Grad der Unfallgefahr abzustufen. Gegliedert ist der Gefahrtarif nach Branchen des Einzelhandels. Dabei sind eine oder mehrere Branchen in einer Gefahrtarifstelle zusammengefasst. Die zu dieser Gefahrtarifstelle gehörenden Betriebe jeder Gefahrtarifstelle tragen also ihre eigene Unfalllast. Der Gefahrtarif regelt somit die Verteilung der Aufwendungen der Berufsgenossenschaft auf die Betriebe, nicht dagegen das Beitragsvolumen. Er ist somit insgesamt beitragsneutral.

Gemäß Abs. 1 Satz 1 setzt die Vertreterversammlung des Unfallversicherungsträgers (vgl. § 33 Abs. 1 SGB IV) im Wege der Satzung (autonomes Recht) den Gefahrtarif fest. Der Gefahrtarif ist in Tarifstellen zu gliedern. Eine Gefahrentarifstelle ist eine kleinere Risikogemeinschaft von Unternehmern innerhalb der in einem Unfallversicherungsträger zusammengefassten Gewerbezweige. Jeder Tarifstelle ist eine Gefahrklasse zugeordnet. Die Gefahrklasse gibt den Grad der durchschnittlichen Unfallgefahr aller in einer bestimmten Gefahrentarifstelle zusammengefassten Unternehmen an.
