Excerpt from a Purchase Agreement for Real Estate:

Sollte eine der in Abs. (7) aufgeführten Erklärungen unzutreffend sein, ist der Käufer vom Verkäufer so zu stellen, wie der Käufer stehen würde, wenn die entsprechende Erklärung zutreffend wäre (§§ 249 ff. BGB).
Ein Rücktritt ist in diesem Falle ausgeschlossen.
Soweit auf Kenntnis ***abgestellt wird***, kommt es auf die Kenntnis des Verkäufers und seiner Vertreter an.

Das erste "abgestellt wird" habe ich mit Hilfe von KudoZ mit "taken into account" abgedeckt, aber mit dem zweiten ***abzustellen*** habe ich Probleme.

If the reasoning/argument (of the opposing party) is based on knowledge, the important factor is the knowledge of the vendor and his/itsrepresentatives.
The requirements for malice, deliberate action or negligence must be assessed in relation to the vendor, his/its representatives and agents.

Presumably the other party claims that some associate of the defendant/respondent knew that the declarations were not true. The author of the text says: whether true or not, that is irrelevant, because you can't claim against my client on the basis of what somebody else knew.

On the word "abstellen": I have seen it used in this sort of way a few times, but this use doesn't seem to be encoded yet in any dictionaries (at least, not in Dietl/Lorenz or Lister/Veth). Romain gropes in this general direction with "to refer to as authoritative", but that doesn't work in this context.
