This is from a list that information should not contain, one of it is trade libelous information. I know what trade is and what libel is, but cannot find the Dutch for the combination of trade libelous and/or trade libel. Anyone?

Like disparagement, trade libel IMO is pre-eminently US Am. for the BrE civil-law tort offenc/se of malicious or injurious falsehood of goods or trade - 'Malicious or injurious falsehood (sometimes referred to confusingly as 'trade libel') is not concerned with reputation(?). It is a separate tort to defamation (?).' Thus, it's an area of tort not well understood by law students.

Otherwise, I have an idea of what the Anglo-Am. terms of trade libel and libelous mean, but am none too sure of my Teach-Yourself Dutch therefor and think the answer is buried somewhere in the example sentences.

Okay, op basis van jouw toelichting uitgaande van 'Trade libel': "Trade libel is the publication of a false statement of fact that is an intentional disparagement of the quality of products or services of another’s business which results in pecuniary damages. It is a business tort that permits the injured party to seek compensatory and punitive damages.

Veelal wordt 'smaad en laster' in de advocatuur samen genoemd om het hele gebied af te dekken, maar als het om 'zwart maken'gaat zoals je aangaaft zou het om smaad gaan.
Als het echter gaat om het bewust doen van onjuiste beweringen dan zou het laster zijn. In de definitie hierboven wordt juist over 'laster' gesproken.

Notes to answerer
Asker: Bedanks Willem, maar het gaat me juist om de combinatie van trade en libellous. Dus smaad in de zakelijke omgeving zou ik maar zeggen. Ik ben het in het Nederlands nooit tegengekomen, maar ik denk dat het gaat om het zwart maken van een ander bedrijf.

disagree  sindy cremer: 'Trade' heeft hier niets met context te maken-het is een term:TRADE LIBEL. Synoniemen:neen: er is een verschil tussen smaad en laster.//De vraag was TRADE libellous. Je geeft smadelijk als alternatief-dat is misleidend en fout vanw. het vermelde verschil.
