freeholder, lessor/landlord, superior landlord Explanation: Which term you choose will be based on your emphasis. Writeaway's reference material states that "De persoon, die dit recht verleent, is de opstalgever en blijft steeds eigenaar van de grond". The legal person who retains ownership of the land is called the freeholder and retains the freehold over the land. So if your emphasis is on who owns the land, freeholder is your choice of translation. The freeholder can grant a lease of the land for a specific period and in his/her capacity as the grantor of that lease, is called the lessor or the landlord and the terms lessor and landlord are used interchangeably but only one in any document, the landlord being defined within the lease. If the lease is, in fact, a sub-letting, (in which case the lessor will be someone who himself has a lease from the freeholder), then there may be a superior landlord who retains the freehold of the land. When translating from the point of view of the grant, as opposed to the point of view of the ownership, you will need to choose between lessor/landlord and superior landlord, in order to clarify the position of who is granting the lease. |
