Dutch term

tot bewijs toelaten

Dutch to English Law/Patents Law (general) Court Judgment
Hi - I'm having difficulty determining the correct translation for this. It appears at the end of the beslissing portion of a court judgment. Unsure whether this is "admits XXXX's evidence in 6.2" or something else. It appears as follows:

laat XXXXX toe tot het in rechtsoverweging 6.2 omschreven bewijs;

Thanks for your help!

Discussion

dmesnier (asker) Nov 27, 2022:
And indeed, the subsequent judgment states the following (referring to this present judgment "Bij het tussenvonnis van [date] is [claimant] toegelaten tot het leveren van het bewijs dat door of namens [respondent} opdracht is gegeven tot meerwerkzaamheden zoals omschreven op de volgende facturen (met bijlagen). So allows to give evidence it is. Thanks everyone!
dmesnier (asker) Nov 27, 2022:
Oh the other hand, the reference provided below "de eiser tot het bewijs toelaten =
to allow the claimant to give evidence" may actually be better; this project includes a later court record of witness statements supported the facts stated in 6.2. So the court is saying the claimant may now proceed to provide supporting evidence of its claims.
dmesnier (asker) Nov 27, 2022:
I should have clarified that XXXX is the claimant. 6.2 concerns the invoices the claimant has submitted to prove the respondent owes them money. I'm thinking now "admits XXXX's evidence" in this context is the best. Thanks though for everyone's fine contributions!
Barend van Zadelhoff Nov 27, 2022:
@ Hi D. What does 'rechtsoverweging 6.2' say in your text?
Michael Beijer Nov 27, 2022:
@Barend: Inderdaad. Zie ook mijn JurLex ref.:

de eiser tot het bewijs toelaten =
to allow the claimant to give evidence

iemand tot tegenbewijs toelaten =
to allow a person to prove the contrary
Barend van Zadelhoff Nov 27, 2022:
Let's take the Bakaro example

In 4.2 you'll find:

Bakaro zal worden toegelaten tot het leveren van tegenbewijs tegen deze voorshands bewezen geachte stelling van de Gemeente.

Then, in the 'Beslissing' you'll find as the first item in the list:

De rechtbank:

- laat Bakaro toe tot het in rechtsoverweging 4.2 omschreven tegenbewijs;

https://www.uitspraken.nl/uitspraak/rechtbank-amsterdam/civi...

So in this context it means that Bakaro is allowed to 'make their [counter] case'
Barend van Zadelhoff Nov 27, 2022:
laat [naam gedaagde] toe tot het in rechtsoverweging 4.21 omschreven bewijs;
laat [geïntimeerde] toe tot het in rechtsoverweging 5.7 omschreven tegenbewijs;
laat Breevast toe tot het in rechtsoverweging 4.5 vermelde bewijs;
laat [naam stichting] toe tot het in rechtsoverweging 4.6. vermelde bewijs;
laat [gedaagden in conventie, eisers in reconventie] toe tot het in rechtsoverweging 4.9 bedoelde bewijs;
laat Bakaro toe tot het in rechtsoverweging 4.2 omschreven tegenbewijs;

Breevast and Bakaro are companies.
Barend van Zadelhoff Nov 27, 2022:
'XXXXX' refers to entities like:

- (naam) gedaagde
- geïntimeerde
- (naam) stichting
- gedaagden in conventie, eisers in reconventie

That is, to a person/persons or an organisation.

I guess this may change the reading of this fragment.

admit as evidence

laat XXXXX toe tot het in rechtsoverweging 6.2 omschreven bewijs > does let in (admit) XXX as part of the evidence referred to in point (matter) of law 6.2.

Too much info missing; 1. a civil or criminal case 2. whether xxx is a litigant, 'real evidence' : a tangible object like the 'smoking gun' or - as a consideration of law' is proof of foreign (non-Netherlands) legislation e.g. extract of a statute or enactment
Example sentence:

Generally, foreign law is proved by expert evidence. Legal texts and foreign case law can only be placed before the court as part of the expert evidence.

neutral philgoddard : XXXX is a litigant, so this doesn't work.
