Dutch term or phrase: Ondergeschikt gedaagde
BELGIUM hearing: secondary defendants?
I'm worried about calling them "secondary defendants" and giving them less liability in the TT than they have in the ST. There is no context, it doesn't talk about who they are. However, I think it might be another subsidiary of the company that's the defendant.

English translation:secondary/subsidiary defendant/respondent
Explanation:
I don't see any problem with a literal translation. We don't know why they're secondary, but that's probably apparent from the rest of the document.

ELDRIDGE v. Of Whom, Greenwood County is, Secondary Respondent/Appellant.

a claimant must give a secondary respondent reasonable access to the property for defect inspections.

Co-defendant

Explanation:
Co-Defendant - in England + Wales - if added by the Plaintiff and pluralised to Co-Defendants if a company. Third-party Co-Defendant if joined in by the Principal Defendant.

If there are multiple defendant parties, there would be a Main Defendant and numbered Co-Defendants *next listed thereunder*, such as the Second, Third or Fourth Defendants.

Example sentence(s):
  • The Court of Appeal has confirmed that defendants may serve a contribution notice on a co-defendant as an alternative to their primary defence of the claim, even if that co-defendant has reached a full and final settlement with the claimant.

neutral  philgoddard: No, that's medegedaagde. "Ondergeschikt gedaagde" appears to have been coined specifically for this context, and gets almost no hits.

  -> That's reverse logic. The term may be Flemish. See Tina V's comment.

agree  Tina Vonhof (X): Ondergeschikt gedaagde may be Flemish. This person/company is not on the same level as the primary defendant in the case.
