This describes an auction lot that is yet to be allocated after bidding has ended.

Het kan zijn dat de kavel onder gunning staat.
Dit houdt in dat de opdrachtgever na afloop van een veiling bepaalt of de kavel wel of niet aan de hoogste bieder wordt toegewezen.

Is there a special term for this in English?

Thanks to you both for the informative replies I chose "subject to acceptance" for my translation into UK English, though I can see it may be different for US English.

I think "onder gunning" here is synonymous with "onder voorbehoud van gunning", in which case I think it could be translated as " subject to acceptance (by the seller)", as per JurLex/OGL, e.g.

I think "onder gunning" here is synonymous with "onder voorbehoud van gunning", in which case I think it could be translated as " subject to acceptance (by the seller)", as per JurLex/OGL, e.g.

“Subject to” Acceptance

When a property is sold “subject to,” it means the property is being sold “subject to” the seller’s approval. Sellers set a Reserve Price, which is the minimum amount they will accept. Sometimes the highest bid is still below the Reserve Price. When this happens, the sale is “subject to” the seller’s acceptance.

with reserve / conditionally sold / under contingency

"onder gunning staan" implies that the item is with reserve or is conditionally sold.

"With reserve" means the seller retains the right to accept/decline bids before money exchanges hands... for whatever reason. The most common reason is the price; hence, the commonly used eBay term "reserve price".

All auctions with reserve are subject to confirmation, as there is no requirement for the "reservations" to be disclosed. The reserves can be anything from a minimum price to the knowledge that the high bidder intends to use the land/property/item for a desirable purpose. If it involves animals, sometimes there can be conditions on the type of home environment or care you are capable of offering the animal. In these cases, the seller can nullify someone else's bid and/or withdraw the item from being sold simply by bidding themselves on the item or outbidding other buyers... as they do on Queen Sugar.

Other forms of reserve can be in the form of making the sale conditional or setting contingencies (e.g. a "contingency auction" or a "contingency award" such as a scholarship that is contingent upon you passing an entrance exam to a university, or "contingency fees" that are only paid to an attorney if you win a case).

So, I'd say the land is under contingency, conditionally sold, or [auctioned] with reserve.
