English term
a wasting investment
English to French
Law/Patents
Law (general)
will/trustee powers/investment
This is part of a will, in the list of powers conferred upon the trustees:
"I declare... my Trustees shall have the following powers:
- to postpone any sale [...] of any part of my estate [...] for any period of time they think fit without being responsible for any loss, even though the part concerned may be comprised in a **wasting, speculative or reversionary investment;**"
My current draft:
... même si la part concernée est comprise dans un investissement de gaspillage, spéculatif ou de réversion ;
I am not sure about "investissement de gaspillage" - is there a better term?
Thank you for your help.

: makes no sense whatsoever - no one would be remotely interested in buying "un investissement à fonds perdus" (=no return expected ever, money vanished in thin air), so selling THAT kind of investment is a non-starter, at any point in time.

Investissement descendant

: No, this term describes a phase in an investment (i.e. it can fall and rise) whereas a wasting investment is one that declines ab initio. Have a look at https://www.wallstreetmojo.com/wasting-asset/

Discussion
The Law of Scotland Affecting Trustees - "An example of a purely wasting investment is a coal mine..."
https://books.google.ca/books?id=kUUwAQAAMAAJ&pg=PA639&lpg=P...
https://www.canlii.org/fr/ca/csc/doc/1980/1980canlii32/1980c...
https://www.canlii.org/en/ca/scc/doc/1980/1980canlii32/1980c...
as the longer you wait the less you would get trying to sell it, which agree with
"my Trustees shall have the following powers:
- to postpone any sale ... without being responsible for any loss, even though the part concerned may be comprised in a wasting ... investment" =
=> my Trustees won't be responsible if they lost money because of delaying the sale of this "wasting investment"
the other definition
"wasting investment (plural wasting investments)
(finance) Stocks redeemable on a certain date at a fixed price, for which a premium above the redemption price is paid."
doesn't fit in this ST. This investment was initially overpaid (= the premium), but except for that there are no other losses, no matter at which point in time you sell it. (important element as the timing of the sale matters in this ST)
(finance) Stocks redeemable on a certain date at a fixed price, for which a premium above the redemption price is paid.

https://www.btb.termiumplus.gc.ca/tpv2alpha/alpha-fra.html?l...
Et pour le même terme, on a, sur le GDT:
bien consomptible n. m.
bien sujet à épuisement n. m.
actif défectible n. m.
https://gdt.oqlf.gouv.qc.ca/ficheOqlf.aspx?Id_Fiche=8376254
wasting assets : An asset with a finite life which becomes gradually less valuable as time goes by.
