Radi se o testamentu i beneficiary bi bilo nasljednik, ali ovo residuary nikako da riješim. Radi o dva brata koji su jedini nasljednici navedeni u testamentu i cjelokupna imovina se dijeli na jednake dijelove njima dvojici. Zato me to residuary toliko i zbunjuje. U jednom dijelu teksta piše 'they are appointed joint executors, and they are the residuary (and only) beneficiaries under the will'. Ako se residuary odnosi na preostalu imovinu prema definiciji dostupnoj na internetu, kako onda u isto vrijeme mogu da budu i residuary i only?

Samo se različito tretiraju zavisno od toga da li nasleđuju kao zaveštajni (testamentalni) naslednici ili kao zakonski naslednici.
Ako ostavilac u testamentu precizira kome od naslednika šta od imovine ostavlja, taj naslednik to nešto konkretno nasleđuje na osnovu testamenta, a ono ostalo - što nije precizirano - nasleđuju kao zakonski naslednici na osnovu zakona - po naslednim redovima.

What creates confusion is that in fact what is "residuary" is "the residue" of the inheritance, they are not "residual" people.
They are "residuary" beneficiaries of the will in the sense that whatever was not explicitly listed in the will (and thus not explicitly allocated to anyone) will be given to those "residuary" beneficiaries.
They are certainly not "residuary" beneficiaries in the sense that they will be given what's left of the inheritance after OTHER beneficiaries got their parts, as in this case there simply in NO "other beneficiaries".
То су "наследници преостале имовине", тј. "преостале" у смислу да та имовина није побројана (изричито наведана) у тестаменту.

the residuary (and only) beneficiaries under the will =
-- residuary beneficiaries = what they inherit is the "residue" of the inheritance after paying off various creditors
-- only beneficiaries = no one else will inherit the "net amount" of this inheritance.
One way or another, can't see what else could make sense if not

Žao mi je, ali uopšte ne razumem šta želite reći... ;)
Ovo je samo moj pokušaj da pomognem u pronalaženju korektnog prevoda, a ne i neki konkretan predlog prevoda.
Текст није о некоме ко се најео буника и прича свашта, у питању је тестамент т.ј. врло приземна тема где свака реч мора да има смисла.
Једино значење које пије воду у овом тексту је "преостала имовина", преостала након што је подељено или исплаћено оно за шта се знало коме исплатити или деделити. Што уосталом не противрећи тој дефиницији, иако није потпуно исто.
