English term

adultery

Non-PRO English Other General / Conversation / Greetings / Letters adultery
In Scotland in the 1800s, bigamy was more common than divorce, which had been available on the grounds of adultery since 1560.

What adultery stands for here? Cheating or just fornication because I didn't really get how it is "Available"?

Thanks in advance,

Thank you all.
Mark Robertson May 21, 2021:
Background The Protestant Reformation took place in Scotland in 1560. The Scots reformers were Calvinists and did not regard marriage as a sacrament and divorce was therefore permitted. Unlike the biblical definition of adultery, which is voluntary sexual intercourse between a married woman and a man who is not her husband, Scots law followed Calvin and treated men and women equally in matters of adultery. "A man may hold the primacy in other things, but in bed he and his wife are equal." John Calvin.

Here "divorce had been available" means "divorce could be obtained/had been justifiable on the grounds of..." adultery [cheating].

I believe the woman can marry another man if her husband betrayed her.

divorce, which had been available on the grounds of adultery means you could divorce if adultery was the case

voluntary sexual intercourse with a person of the opposite sex who is not one's spouse

Adultery: In Scots law, when a married person has voluntary sexual intercourse with a person who is not their spouse. Adultery can only be committed between two people of the opposite sex. Adultery is a fact that can be used in divorce proceedings to establish that a marriage has broken down irretrievably and that decree of divorce should be granted. (See section 1(2)(a), Divorce (Scotland) Act 1976.)

In Scots law, adultery therefore does not include voluntary lesbian or homosexual sexual relations between a married person and someone who is not their spouse.
