Chef d'accusation pour jugement déclaratoire
"A declaratory judgment is typically requested when a party is threatened with a lawsuit but the lawsuit has not yet been filed; or when a party or parties believe that their rights under law and/or contract might conflict; or as part of a counterclaim to prevent further lawsuits from the same plaintiff (for example, when only a contract claim is filed, but a copyright claim might also be applicable)."

"A count is a part of an indictment or an allegation in an indictment charging the suspect with a distinct offense. In a complaint or similar pleading it refers to the statement of a distinct claim."

Germaine
: Non. Ce serait "judgment upon the merits".

English term (edited):
(AmE / CanE) count for declaratory judgement
seul chef de demande pour jugement déclaratif
if this is a patent, then unlikely to be a criminal indictment / l'accusation lors du dépôt de plainte.

Discussion
- requête en jugement déclaratoire ou
- requête introductive d'instance en jugement déclaratoire.
Néanmoins, "chef de demande" s'emploie:

A.− DR. (...) - − P. ext. Qui constate sans engager la conscience.
Déclaratoire
