German term

Arrestierung

German to English Bus/Financial Law: Contract(s) Vollstreckung
Unable to find this term anywhere, maybe specifically used in Swiss Law. It must mean freezing assets or seizure of assets. Has anyone come across this? Thank you for your input

'und andere Vermögenswerte..' - would not - as Barbara S. in Germany would know - rule out the arrest of ships(or distraint of goods) through the sequestration process.
Barbara Schmidt, M.A. (X) Jul 23, 2019:
Does it say it's about a ship?

Here's an entry I found in support of Kim's suggestion:
Seizure is the act of law enforcement officials taking property, including cash, real estate, vehicles, etc., that has been used in connection with or acquired by illegal activities. Property may also be seized to satisfy an unpaid judgment, as long as proper notice of the amount due has been served. A court or civil authority decides what is to be done with the property, such as selling it at a sheriff's sale. In the event of a "not guilty" verdict, assets are returned to the owner.

seizure/arrest

I'm not sure if there is a difference between seizing and 'arresting" assets.

Creditors may request the courts to take certain measures to secure the debtor's assets in order to make them available for eventual liquidation. The most important of these measures are the arrest of assets (Arrest / séquestre) and the challenge of unfair preferences (Anfechtung / révocation).

Debt collection by seizure of assets (Betreibung auf Pfändung / poursuite par voie de saisie): If the debt is not secured, and if the debtor is not a registered commercial entity but a private individual, all his assets can be seized and sold at auction.
Arrest
Creditors may request a court to order an arrest to be laid on certain assets belonging to the debtor. The arrest has the effect of a provisional seizure of these assets.[32]
An arrest may only be ordered if the creditor can establish the prima facie validity of his claim as well as one of several statutory prerequisites for an arrest. An arrest may notably be imposed if the debtor holds a certificate of unpaid debts against the debtor, if the debtor attempts to hide or dispose of his assets, or if the debtor is not resident in Switzerland. The arrest of the assets of foreign debtors also establishes a venue in Switzerland under Swiss private international law in which the debtor may be sued by the creditor, except if the Lugano Convention is applicable.[33] https://en.wikipedia.org/wiki/Insolvency_law_of_Switzerland

German term (edited): Arrestierung > (CH) Arrestlegung

sequestration; arrest (of ship)

I'm unsure of the target readership, but sequestration ought to be avoided for Scottish (= bankruptcy) consumption.

Normally of foreign government or trade union assets, ex-UK PM Margaret Thatcher having had the (NUM) National Union of Miners' funds sequestered by a court.appointed 'sequestrated' to break the GB/ leader Arthur Scargill/ miners' strike of yesteryear (1984-5).

In the US, sequestration is a remedy in equity-

internationale Zwangsvollstreckung > international levy of execution

Arrestlegung in the CH kleiner Merkur of Swiss law comes out to much the same as Arrestierung.

Pls. also note: WFOs - Worldwide Freezing Orders, previously known as Mareva injunctions after an eponymous case.

Note also: garnishment in AmE; attachment and, generally distraint

Danke schön und thanks! It's good to have US approbation.
disagree Barbara Schmidt, M.A. (X) : 'arrest' has been mentioned before by someone else.

Indeed, but the respondent had been unsure of the use of the word, so I narrowed down to ships: that you - with your knowledge of Anglo-Am admiralty law - possibly also disagree with.
