I see "with prejuduce" is given in an earlier Kudoz entry but is that really correct in this context?:

"Besonders zu beachten ist Art. 559 ZGB. Er lautet: "Nach Ablauf eines Monats seit der Mitteilung an
die Beteiligten wird den eingesetzten Erben, wenn die gesetzlichen Erben oder die aus einer früheren Verfügung Bedachten nicht ausdrücklich deren Berechtigung bestritten haben, auf ihr Verlangen von der Behörde eine Bescheinigung darüber ausgestellt, dass sie unter Vorbehalt der Ungültigkeitsklage und der Erbschaftsklage als Erben anerkannt seien. Zugleich wird gegebenen Falles der Erbschaftsverwalter angewiesen, ihnen die Erbschaft auszuliefern."

I think "caveat" is incorrect here, in that it is not mentioned by the author and the the proceedings are presently at a prior stage to a caveat.
Alternative (more risky, by referring to an action): subject to any action challenging the validity [of the will] or the status of one or more heirs as heirs.

You are getting into depths of conditional mood v. subjunctive mood etc. My point is that the author is presuming his/her ignorance of whether there is or will be a challenge to a will or the proposed disposition (e.g. Declaration of Inheritance).

subject to the caveat (E&W: entered) of an impending probate action for...

Warning /'caveat' has a technical meaning in English probate to stop a grant of probate pending possible litigation and is equivalent to a 'caution' in UK land registration to stop first reg. of the land or dealings therein, though - from my own experience - many veteran UK, especially conveyancing, Solicitors who should know better mix up the two.
Example sentence:

Once a caveat has been issued by the Probate registry, this then prevents a grant of probate or grant of letters of administration being issued by the Court

Absent a will contest, a temporary administration will usually only be granted if there is an emergency. The probate court can order a temporary administration regardless of whether the decedent died with or without a will.
