المانع الأدبي لتقادم الحق في الدعوى
The sentence is as follows:
تقدير وجود المانع الأدبي بالحق يعد سببا لوقف التقادم طبقا للفقرة أ من المادة 373 من القانون المدني وإن كان من مسائل الواقع التي تستقل بتقديرها محكمة الموضوع فإنها إذا أوردت أسبابا لوجود هذا المانع أو نفيها، فإن هذه الأسباب تمتد إليها رقابة محكمة التمييز
My translation currently stands as:
Appraisal of whether there is a moral impediment to claiming entitlement which is deemed to be grounds for suspension of limitation in accordance with Section A of Article 373 of the Civil Code, notwithstanding that this is a substantial matter which is a prerogative of the court having substantial jurisdiction, should it be adduced as grounds for this impediment’s existence or denial thereof, then these grounds shall come under the Court of Cassation’s oversight.
I assume that the ها of إوردت أسبابا refers to مسائل الواقع and that أوردت is passive while أسبابا is a case of accusative of تمييز Am I right in this. These two words seem to be the pivot, but anything to improve the general sense of the whole sentence is greatly appreciated.
