il campo di applicazione. Ai sensi dell’art. 26, primo comma, alinea, gli obblighi
di collaborazione prevenzionale a carico del datore di lavoro committente scattano
“in caso di affidamento di lavori, servizi e forniture all’impresa appaltatrice o
a lavoratori autonomi all’interno della propria azienda, o di una singola unità
produttiva della stessa, nonché nell’ambito dell’intero ciclo produttivo dell’azienda
medesima, sempre che abbia la ***disponibilità giuridica dei luoghi*** in cui
si svolge l’appalto o la prestazione di lavoro autonomo

I presume this refers to the company having legal responsibility for health and safety in the locations where the work is carried out, but I wondered if there was an equivalent term in English?

Hello Judith and Michael, I fully understand your point. To be honest, I answered the question without the input of Stuart, my husband, who is a lawyer. However, checking the previous Proz answers, I found 'legal control' answered also by a lawyer, who we have worked with in the past. I did not think of 'juridical availability' and when researching on Google after I saw your answer, I only found very few entries, including this:

'a faculty' or power' of the individual, which he glossed as a 'facility' -- something which gives an individual the juridical availability of something else.

How would you then describe 'juridical availability' in other words. Would this be not the power or faculty that somebody has over something else?

Thank you Michael. I didn't choose to use 'control' in my translation because in the end I felt it may be too strong and I concentrated more on the right to use. But thank you for your very valid point.

You asks your question you makes your choice:))) However,
I just had a team of builders doing some restauration work in my house. They had access to the site and the municipality permit to conduct works on the site. That makes sure that the insurance they carry would apply in case of accident, and that the authorities confirm the legitimacy of their work on the site.
But to say that they have "legal control over the location" (my house!) is, pardon me, totally absurd. I can't emphasize too much the fact that I'm providing this example solely out of purely collegial consideration and in order to help you, for I would be very worried about your choice.

I think this would be 'right to enjoyment of property' but I don't think it quite fits in the context.

Otherwise, I found here in PROZ:

'legal control' = disponibilità giuridica' which would do the job.

juridical availability of the sites...


In legal specialised translations (especially from Romance languages), calques/cliches often work very well exactly because both the Romance- and English-language legal argots are still strongly linked to their common origin in Latin.
This is a good case in point. Pls. see an official translation below for an example:
