و لما كان ما تقدم وكانت المستأنفه تمسكت فى دفاعها امام محكمة اول درجة بعدم وجود هذا العقد المزعوم ( عقد القرض ) و انها لم ترتبط مع المستأنف ضده باى علاقة عقديه على الاطلاق وانها لم تتسلم منه هذا المبلغ وان هذه الشيكات مختلسة منها من زوجها الذى هو ابن المستأنف ضده و تمسكت بانها لم تتسلم هذا المبلغ من المستأنف ضده وان وجود دعوى احوال شخصية بين المستأنفه وابن المستأنف ضده ( الذى هو زوجها )و صدره فيها احكام قضائيه ضده مما يدل على وجود خلاف سابق على التاريخ المزعوم في تسليم القرض بينها
