الفقة كلمة مرادفة للإتجتهاد وفي نفس الوقت تعنى فهم الدين دون اجتهادات. ولكن الاجتهاد لا يحصل إلا في حالة عدم وجود نص
صريح متفق عليه ومتواتر
(فلو لا نفر من كل فرقة منهم طائفة ليتفقهوا في الدين ولينذروا قومهم إذا رجعوا أليهم لعلهم يحذرون)
دون اجتهادات ممن يتفقهون لأن ذلك على عهد الرسول وهو المعلم للدين ويتعلم الجميع منه
ولذلك قال (ص) ما لم يكن عليها أمرنا فهو رد
