In zoverre de notaris door middel van de fiscale notificatie kennis krijgt van de schuldvordering van de ontvanger, dient de notaris derhalve ook met deze schuldvordering rekening te houden bij het opstellen van het proces-verbaal van rangregeling, ook al werd naar aanleiding van de fiscale notificatie, die als een beslag onder derden geldt, geen beslagbericht opgesteld, nu dit wettelijk niet is voorzien.
Dans la mesure où la créance du receveur est portée à la connaissance du notaire par la notification fiscale, le notaire est obligé de tenir compte de cette créance lors de la rédaction du procès-verbal d'ordre, même si un avis de saisie n'a pas été rédigé à l'occasion de la notification fiscale, qui emporte saisie-arrêt, dès lors que la loi ne le prévoit pas.
