6. THERE IS EXCEPTED AND RESERVED out of this Transfer for the benefit of the Vendor's retained land:-

(a) the free passage of water soil gas electricity and other matters from and to the Vendor's retained land as now used and enjoyed through any drains pipes cables or conduits now existing or hereafter to be substituted therefor in under or over the property

(b) the right to use all or any part of the Vendor's retained land for building or other purposes whether or not such use shall obstruct or diminish the access of light and air now or at any time hereafter enjoyed by the owner or owners or occupiers for the time being of the property to or for any building or other erection now or hereafter to be erected thereon;

(c) a right of way for themselves and all persons authorised by them at all times for all purposes connected with the use and enjoyment of the Vendor's retained land and with or without vehicles over all roads and footpaths hereinafter constructed on the property for the purpose of gaining access to and egress from the Vendor's retained land or any part or parts thereof from and to the public highway and until the satisfactory construction of such roads and footpaths and the connection thereof to the Vendor's retained land in accordance with the Purchaser's covenants in that behalf herein contained a like right over the property by such route or routes as may be mutually agreed from time to time by the Purchaser and the Director of Property so as to minimise any interference with any works or development carried out by the Purchaser on the property;

(d) the right at their own expense and for the benefit of the Vendor's retained land to connect free of charge into the said foul sewer pipe and surface water pipe or either of them at any time or times within a period of eighty years from the date hereof and to use the same for the drainage of the Vendor's retained land provided that such connection or connections will be made only with the approval and to the required standards of the appropriate Water Authority and such rights shall not be used or exercise in such a manner as to interfere with or reduce the capacities of the said foul sewer the surface water pipe or drain adequately the property Provided that in the case of any such connection or connections being made before the adoption of the foul sewer pipe and the surface water pipe it or they will indemnify and save harmless the Purchaser and its successors in title from and against all actions claims and demands which may be brought or made against it or them by reason of any accident or injury to any person or damage to or loss of property arising directly out of the exercise of this right and against all damages costs and expenses occasioned to the Purchaser or its successors in title thereby or which they may be required to pay or bear by reason or in consequence thereof."
