what approach is ineffective

Hello everyone,

With respect to money laundering (ML), in Article 183 (ML of criminal assets) of the Penal Code, XXX introduces verbatim UNTOC requirements, as per article 6, paragraph 1, a and b (ii) on ML offences. Yet, XXX does not seem to decouple the ML offence from the predicate offence. The predicate offence needs to be established in order to proceed with the prosecution of the ML offence. Such an approach is ineffective and calls for review of the legislative framework.

I'm not sure what approach is ineffective?

This one: The predicate offence needs to be established in order to proceed with the prosecution of the ML offence?

Or the one that doesn't decouple the ML offence from the predicate offence?

the UNTOC requirements as laid down in this Article 183 of the Penal Code

Being a total non-expert in this field, I'd have said that the 'approach' mentioned is the whole of the implementation of these UNTOC requirements.

It seems to me that the two sentences beginiing with "Yet..." are simply an explanation of WHY the 'UNTOC requirements' approach is ineffectice.
