French term
remis à la concurrence
French to English
Bus/Financial
Law: Contract(s)
Terms & Conditions
From the terms and conditions of leasing office equipment. Specifically, this sentence comes from the WEEE management section.
It explains that, at the end of the lease, the Client can either scrap the product itself or pay the lessor to dispose of it on its behalf.
For this service, a fee is payable:
"Cette participation forfaitaire, payable à la livraison du Produit, est non remboursable au cas où [Bailleur] se trouverait dans l’impossibilité d’assumer ses obligations du fait du Client (Produit ****remis à la concurrence****, Produit ne pouvant plus être restitué, option d’achat non levée...).
I know that "remettre à la concurrence" can mean putting something out to tender but I'm not sure it's the case here. Equally, I don't really understand why it would mean "competitors" in this context.
All thoughts welcome!
Thanks,
George

made available to competitors (of the lessor)
The text is stating that there are certain circumstances under which this deposit would not be reiumbursed even when the goods are not collected at the end of the lease. One of those circumstances is when the leased material has been made available to competitors. That is the only way that I am able to make sense of the given text "Made available" is vague because I connot see from the text here, whether it means the leased material might be sold, sub- leased or simply shared.

If there is little more to go on, I tend even more towards "made available" because that covers handing over, letting, giving, selling etc. I cannot see how "returned" could be right because the competition did not have the leased material previously, so it is not "returned" to them.

Note from asker:
Thanks for your input. The source text contains very little other information about this clause. My current theory is that "remis" might mean "handed over" rather than "returned" in this sentence. Think it's one for the client.... |
Discussion
"Q: What is meant by "remis à la concurrence" in thhis context? => Give it back to the current supplier"
So I respectfully pointed out that they might want to alter the source text! Thanks to all for their input on this query.
