Marktgerechtheitsprüfung

German to English Bus/Financial Accounting annual report
A client of mine has replaced Marktgerechtigkeitsprüfung with Marktgerechtheitsprüfung. I looked on BaFin's website, but could find no reference to the new wording. Would I be correct in assuming the English phrase "market conformity check" remains despite the change in the German?

Sie haben recht... Transactional testing is wrong... All of the US/UK prospectuses and annual reports I have read make no reference to a specific test in this context, so the search continues!

Beim "transactional testing" liegt der Fokus auf.. ... der Prüfung, "whether compliance policies and procedures are adequate and working as intended". Also ich meine, das geht in eine ganz andere Richtung und passt hier nicht.

hmmmmmm. I'm still wondering about this one. I accept that Marktgerechtheit is the term the client should have been using lo these three years, so it was obviously someone new on the job who made the change. But I am still questioning the English term. "market conformity check/testing" seems to have the most hits with German websites, while "compliance testing" seems most often to refer to manufacturing - and is seldom seen with "market compliance testing". The context here, sorry for not listing it earlier, is the annual report for an investment management company with ETFs. Any other thoughts?

Es gibt den Begriff "Marktgerechtigkeit" zwar ... ... in der Wirtschaftsethik im Sinne von "Tauschgerechtigkeit" (und in Abgrenzung zur "Verteilungsgerechtigkeit", vgl. http://de.m.wikipedia.org/wiki/Tauschgerechtigkeit), das ist aber m.E. ein anderes Konzept.

Bei der hier beschriebenen Kontrolle geht es um die Marktgerechtheit von Vorgängen. Daher hoffe ich wirklich, dass sich die BaFin auch noch eines Besseren besinnen wird (so wie offensichtlich hier der Kunde der Fragestellerin und auch einige andere Unternehmen, die diese Prüfung anbieten) und die Bezeichnung anpasst.

o.a.s. = or other specifics/characteristics of the financial products relevant to the investor (I was facing space constraints there). The other specifics could include the fees the investor is charged, the term to maturity of the product, other terms and conditions.

Prices may backtranslate as Kurse here, depending on the type of product. Kurse are Preise/market prices, too.

I have just suggested another way of saying this. The two German terms Marktgerechtigkeitsprüfung and Marktgerechtheitsprüfung designate the same thing, it's just that I thought I could try my hands at making the English term a bit clearer so that it tells.

Obviously, as I have posted an example of usage from the field of MaRisk ( minimum requirements for risk management), the risk of the issuer failing to pay back the money it has borrowed from the investor under the bond at maturity (or another form of issuer default happening) or even the issuer of the product filing for insolvency is to be mentioned in the context of other product specifics checked for compliance with market conditions.

This definitely describes what the German term means, but isn't there a consice term in English that does the same? It's probably very simple, just can't find it...

I agree that she is a very good specialist translator indeed. I have suggested "(running a) check for compliance with market conditions" in a second attempt, which isn't so bad IMO.
agree EK Yokohama : with "check for compliance with market conditions" (for "Marktgerechtheitsprüfung") and "in line with market conditions" (für "marktgerecht"). / Für mich hörte es sich so an, dass die Fragestellerin ein Glossar des Kunden anwendet, in dem es Änd. gab...

market conformity check

Das ist der übliche Term im Deutschen. Bei der MarktgerechtIGKeitsprüfung" handelte es sich offensichtlich um einen Schreibfehler, denn zu dem Adjektiv "marktgerecht" lautet das Nomen "Marktgerechtheit" (nicht "Marktgerechtigkeit").

Leider verwendet auch die BaFin (und andere...) diesen m.E. nicht korrekten Term "Marktgerechtigkeitskontrolle". Aber entscheidend für dich muss ja sein, wie es dein Kunde im Deutschen formulieren möchte. An der englischen Übersetzung ändert sich dadurch m.E. nichts.

I agree that most German companies are using this term, I just have yet to find a US/UK company using it. There must be a phrase in plain English to signify this.
Thanks so much for your detailed explanations and support. The only thing is that I do not think this is a phrase used by US/UK fund managers.

market compliance check vs. fair trading test

The client's change switches the emphasis to market compliance from fair trading - no need in the latter case to stick slavishly to the word market.

Also the 'translation' of conformity smacks of EU-speak.

I agree about "conformity". But take-e-way is a German company and informars seems to be referring to compliance with policies, etc. not necessarily the market prices.
