Heeft de huurovereenkomst geen vaste datum vóór de verkoop of schenking, dan gelden de volgende regels:

De huurder is niet beschermd als hij de woning minder dan zes maanden bewoont. De koper kan de huurovereenkomst zonder motief of vergoeding beëindigen.
Als de huurder de woning minstens zes maanden bewoont, treedt de koper==== in de rechten=====van de hoofdverhuurder.
