Per tutti coloro che hanno tradotto la parola come obbligo -obbligazione: Qui non si parla di obblighi/obbligazioni. Si parla di responsabilità (che è un obbligo/obbligazione in senso lato linguistico, ma non in modo preciso da punto di vista legale.).
Il testo originale trae in inganno perchè recita "OBLIGATED" quando invece avrebbe dovuto parlare di "LIABILITY" soltanto, visto che si riferisce a CLAIMS e non ad obbligazioni contratte trale parti,ecc.

Ma nel nostro testo, la frase va letta come segue (e qui sono d'accordo con Cynthia Tesser):
...."fermo restando", tuttavia, che l'Ente non sarà soggetto a tale obbligo nel caso di Claims derivanti da dolo o colpa grave dell'Indemnitee dello Sponsor.
