The fines and overdue charges specified in this Agreement shall be paid by Seller from the amounts that are allocated for the payments for goods previously delivered and traded by the Seller. An act written by the Distributor’s employees who *harbor the goods* and/or a claim written by the Distributor one copy whereof is provided to the Seller is the basis for the exaction of fines and overdue charges.
