is more common than "concluded". I'd switch the sentence around a bit:
It is necessary to establish which parties are present (or absent) at the signing of the contract
Or
When signing off on a contract, it is necessary to establish the parties present
You could also say
"It is essential..." for "it's necessary"
but I think you don't really need to say "who is absent" as the concentration is on those present at the signing.

The context, though, suggests that - coincidentally for Romanian - and of preceded by law/drept, the Latin expression lex loci contractus might work for a PIL > private international law booster.

On another ProZ DE>EN question, a retired German judge misguidedly claimed a dubious distinction in Anglo-American law. namely that an agreement was oral and a contract was written.
