Spanish term

no existan

Spanish to English Art/Literary Law: Contract(s)
Hello All,
Could you please tell me how to go about this.
I have problem constructing the translation. How can a person exist and does not exist? Then the last sentence it is estimated that those who exist are the sole beneficiary with the total tax?? sorry!

Los gravámenes en favor de personas que no existan, pero que se espera que existan, no se considerarán como tales para los efectos de esta ley. Si el gravamen se instituyere en favor de personas de las cuales unas existen y otras no, se estimarán a las que existan como únicas beneficiadas con la totalidad del gravamen.

Thank you all for your help in advance.

Thanks but I am still looking to translate this better..This is an inheritance contract.
Sergio Kot Jan 14, 2013:
Agree I agree with Hideki except for the adoption part, as individuals in the process of being adopted already exist. Poor choice of words by some jurist
Hideki Koshizuka Jan 14, 2013:
It seems to me that the sentence refers to those yet to be born (as in, expected children from pregnancy), (or possibly, even from adoption in process but not completed; if the definition of las personas includes those that are potential beneficiaries).

personas que no existan, pero que se espera que existan
-> direct translation: persons/individuals not yet in existence, but are expected to exist

so these taxes do not apply. It's really the principle of who is a "legal person."
