schuldrechtlich vereinbart

Dear colleagues,

The term is used in a Purchase Contract

Would anyone like to enlighten me on the translation of schuldrechtlich vereinbart. Can the term schuldrechtlich be ignored as in some translations proferred by Linguee.com?

The sentence:
Die Käuferin erkennt Beschlüsse der Eigentümergemein- schaft, die dingliche Wirkung dahingehend entfalten, dass sie in das Grundbuch eingetragen worden sind, an, ebenso wie Beschlüsse und Vereinbarungen, die nur schuldrechtlich vereinbart worden sind.

distinction between "dinglich" + "schuldrechtlich" Your text states that the purchaser acknowledges both decisions which take effect "in rem" (and hence are recorded in the land register) and "in personam" / simply as a matter of contract. Given the distinction drawn in the source text phrase, it is important in this case to translate "schuldrechtlich" and not simply to leave it out.

Schuldrecht in Germany deals with debt law or civil material obligations: “Der Teil des Privatrechts, der sich mit der Frage der Schuldverhältnisse beschäftigt. disagree AllegroTrans : "Schuldrecht" is not "debt law" - it is the law of civil obligations as you yourself say - "debt law" is too restrictive here, and not a term used in EN

I have to disagree. Please read my substantiation in this regard: In the UK, debt is dealt with under the Administration of Justice Act 1970 (c. 31) and is a UK Act of Parliament.

contractually agreed (with effect operating) in personam

It's not accordance with the law of obligations but, as commented on, with the idea of the 'Abstraktionsprinzip' of separating a personal contractual interest (das schuldrechtliche Verpflichtungsgeschäft) with the actual delivery of physical possession operating in rem: das dingliche Verfügungsgeschäft> mit dinglicher Wirkung.
