This is an option offered to defendants the court in New York state. A case will be adjourned for a set period during which the defendant must stay out of trouble and perhaps complete community service, etc. Then, at the end, the case will be dismissed and the defendant's record will be clear (although it will appear on the local law enforcement records). On another web site, the translation "suspender (la sesión) para considerar la eliminación (del caso)" was offered, but I would like to get other opinions.

Este término es de España. Parece corresponder exactamente al "ACD" estadounidense:

"In United States criminal law, adjournment in contemplation of dismissal (ACD or ACOD) may be offered to a defendant in the interest of justice with a view toward ultimate dismissal of the charge. The judge usually adjourns the case for a period of six months (sometimes a year) after which time the case will be dismissed as long as the defendant has stayed out of trouble (i.e., has not gotten arrested again). It is neither a form of probation, nor a conviction."

"La “suspensión del proceso a prueba” se postula como una reacción estatal diversa ante el delito, ya no mediante la imposición de una sanción al inculpado del hecho punible y las consecuencias que ello implica, sino a través de su sometimiento a un plan de conducta, elaborado por el órgano jurisdiccional, el cual le impondrá ciertas obligaciones que deberán ser realizadas en un lapso previamente definido. Con la expiración satisfactoria de tal plazo se logrará la extinción de la acción penal.
Como lo indica su denominación,(1) significa la paralización de la causa ante la decisión del presunto transgresor de cumplir determinadas pautas. De manera que, mediante el sometimiento del infractor a ese período de prueba, se propiciará su reinserción social y su separación de ese proceder ilícito.(2)"

Al igual que en el ACD, se suspende o paraliza la causa; no se declara culpable al supuesto infractor ni se afirma su inocencia. Si este cumple las pautas, la acción se extingue.

All the information I'm seeing on this indicates that it is a kind of probation that is not strictly probation since there has been no conviction: it's a conditional suspension of proceedings. Here's part of the actual NY statute (New York Criminal Procedure § 170.55):

"2. An adjournment in contemplation of dismissal is an adjournment of the action without date ordered with a view to ultimate dismissal of the accusatory instrument in furtherance of justice. Upon issuing such an order, the court must release the defendant on his own recognizance. Upon application of the people, made at any time not more than six months, or in the case of a family offense as defined in subdivision one of section 530.11 of this chapter, one year, after the issuance of such order, the court may restore the case to the calendar upon a determination that dismissal of the accusatory instrument would not be in furtherance of justice, and the action must thereupon proceed. If the case is not so restored within such six months or one year period, the accusatory instrument is, at the expiration of such period, deemed to have been dismissed by the court in furtherance of justice."

agree Sandro Tomasi : Suspension a prueba is one way. I am biased towards "suspension condicional" del proceso, procedimiento, caso, causa, expediente, accion, etc. In any case, condicional and a prueba are the only two natural equivalents. Good job, Charles! Not an easy one.

Many thanks, Sandro :) "Suspensión condicional" could be a better term to use. I suspect there is a difference, though, if so, it's a subtle one, and in some places they seem to be treated as synonyms.
