Portuguese term

desafectação dos terrenos

Portuguese to English Law/Patents Environment & Ecology environmental considerations

In a PT dictionary the following two meanings are shown (apart from the meaning 'simplicity' or 'unaffectedness' which is all I can find in Pt/eng dictionaries): 2.
3. Libertar alguém de determinada função. = desvincular

I don't do much legal work - what would be the correct term in English for 'desafectação'? Thanks.

Discussion

Marlene Curtis Mar 18, 2011:
Disaffectation The term disaffectation was coined by noted French psychoanalyst Joyce McDougall as a strictly psychoanalytic term for alexithymia, a neurological condition characterized by severe lack of emotional awareness.

Jennifer Byers (asker) Mar 18, 2011:
Disaffectation Thanks Ivan - I appreciate your time, but i don't believe the word "disaffectation" exists in English, at least I can't find it. Anyone? I know whoever translated the spanish you linked me to used it, but we all make mistakes!! :-)) I know what the term implies, but was hoping for an English legal term for it. Marlene's suggestion (for which, thanks) seems clumsy, but then, so does most 'legalese' to me! Will await further suggestions...thanks to you both for your time.

de-allocation of the land

The equivalent EN legal term for afectação is allocation.

Cf. IATE

"The land was allocated for occupation by traditional communities and is now to be de-allocated.2

"Section 132
1. The law shall lay down the rules governing public and communal property, on the basis that it shall be inalienable, exempt from
prescription and seizure, and it shall also provide for the case of disaffectation from public purpose."

Yes...could be, but in the end I am selecting another answer. Thanks everyone.
Peer comment(s):

agree Lesley S, MA : This one sounds right to me since decommissioning means to "withdraw from active service" which fits nicely into this context.

Thanks Lesley :)
agree Muriel Vasconcellos : In my Chaves de Mello hardcopy legal dictionary the definition of "afetação" is 'allocation for public interest' - so the opposite would be to decommission (I guess). I'd call them 'parcels'.

2. to banish.
3. to abandon ownership of (a building), esp. as a bad investment

Houaiss

A. desafetação

Example on the web
New Forms of Land Dispossession
The development of capitalism continues to pose threat to peoples tenure security and the competing demands on land by various powerful interest is intensifying and threatens the centrality of land and agrarian reforms globally. South Africa is neither exception nor immune to this process. The only difference between the former colonial dispossession and the new is the form that such dispossession takes.

Thanks - that's nearly it, and I probably would have selected this if Mark hadn't submitted his.
Peer comment(s):
