Peer comment(s):

disagree Julian Rippon : I disagree because I believe that 技術的範囲の「属否」 must be related to "whether or not" the device in question "falls under" the technical scope of the patent in question, rather than as is suggested by this answer stating that it doesn't fall under the scope.

whether [the subject article] falls under the technical scope

This sentence is actually from the reference posted earlier by VN Ganesh. (With apologies to VNG for taking advantage of your work.)

"The Japan Patent Office, having a high degree of expertise regarding technology, design and goods, will render an official Hantei in a strictly neutral manner regarding whether the subject article falls under the technical scope of the patented invention in question within as soon as three months from the time of filing of theHantei demand." 1.(1)

www.jpo.go.jp/tetuzuki_e/t_tokkyo_e/hantei.htm

The relevant part of this is "whether the subject article falls under the technical scope of the patented invention in question".
Peer comment(s):

agree JapanLegal : Yes, this is the correct interpretation, as the Japanese version of the explanation of the 判定制度 here should confirm: http://www.jpo.go.jp/cgi/link.cgi?url=/tetuzuki/sinpan/sinpa... . Since "属否" is really two words, there is no "specific term."
