Richard Boulter
: Lacking the context of the phrase, why not this? Actually, it's pretty likely that this is the intention of the source, but it was pretty inconsiderate of Lida's friend to ask without providing sufficient context for a considered response from us.

: The court is unlikely to award costs without saying, albeit by implication, who is to pay them.

This is the preliminary part of the ruling not the decision itself, thank you anyway!

reimburse the costs of litigation, as being part of a case between spouses
compensación can mean alimony, so I take it to mean that the costs of the court case will be covered by the one who pays the alimony.

the dispute being between spouses, it is appropriate to order the parties to bear their own costs
It is a consensual divorce, so it is logical for the parties each to bear their own costs.
Seems to be a 'galicismo' - "compenser les dépenses" is the corresponding phrase in French.

ES: Habida cuenta de la incertidumbre en la que se encontraban inicialmente dichas empresas en lo que atañe a la incidencia de la Decisión impugnada en su situación jurídica y del riesgo de que se les opusiera posteriormente el carácter definitivo de dicha Decisión, no se les puede reprochar que hayan interpuesto los presentes recursos. Por consiguiente, conviene compensar las costas en lo que atañe a dichas empresas demandantes.
EN: In view of the initial uncertainty experienced by those undertakings with regard to the effect of the contested decision on their legal position and the risk that the definitive nature of that decision might subsequently be set up against them, it cannot be held against them that they brought these actions. In relation to those applicants, therefore, the parties must be ordered to bear their own costs.
There is no reason to think that "compensar" in this context bears any different meaning in Peru.

In other words, the unsuccessful party pays the costs. If the parties are both unsuccessful on some heads of claim and successful on others, the parties bear their own costs. It follows that in a consensual divorce the parties would be ordered to pay their own costs.

: why is it "logical" do you have specific knowledge of the Peruvian system? Any refs. to back up your answer? --- it may be logical in UK but we don't have enough context for you to assume this -- a translator should never exceed his mandate imho

I think you will find my suggestion is correct. And I see no logic in your objections. Note that I am not a translator "exceeding his mandate", I am merely suggesting a translation which I believe to be correct. Better to be penseroso than allegro I think
