Older people may be so protected by their carers that they are prevented from achieving fulfilment in their lives. There can be a temptation to stop someone attempting anything which may result in harm, particularly when they have a mental illness such as de-mentia. The relatives of the older person often wish for this protection, mistakenly believing that their father or mother is at risk of injury through carrying out certain activities. The Mental Capacity Act 2005 sets out the requirement to determine the capacity of an individual to make decisions and to act in the best interests of people without capacity, using the least restrictive option. This Act clearly guides all professionals, including occupational therapists, to consider these issues for people with cognitive impairments. If relatives are involved in the treatment planning process then they should have the opportunity to discuss the use of any activities which involve an element of risk. Through discussion, agreement or compromise may be reached.
Appropriate risk taking is a normal part of everyday life and adds quality to the subjective experience. When we take a risk we usually consider the advantages and disadvantages and only act if, on balance, the reason for taking the action is worth the element of risk. The older person's right to take appropriate risks should be considered and appropriate opportunities built into the treatment plan. An older person with a mental disorder has the same legal and civil rights as anyone else. Restraining someone from carrying out an activity may constitute abuse. Protecting an older person from taking appropriate risks may do them more harm than enabling them to do so; this is the balance which needs to be considered (Box 24.2).
