This is a phrase that appears in Art. 58 of the Swiss Code de Procedure Civile, and it is not clear how it should be translated: principle governing provisions. The context is a discussion of which certain laws are "de droit dispositif" (non-binding), and this phrase is being used to support a claim that a judge must not apply automatically (d'office) non-binding rules of law such as those governing, for example, matrimonial property regimes.
I did not find reading the actual legal provisions cited (art. 55, par. 1, Art. 58, par. 1, and Art. 277, par. of the Code of Civil Procedure) to be terribly helpful.
Any help with a suitable English translation for this phrase would be most appreciated. Thank you in advance!

Clause 16. The principle of disposition
All persons concerned independently dispose of their subjective substantive and procedural laws. The claimant can at his own discretion file a claim in defense of the infringed right or refrain from doing it (the defendant has the right to counter-claim), to change the cause of action or the subject of action, to increase or reduce the size of the count, to release the claim, refrain from demanding actual satisfaction of decision which has been adopted in his favor, etc. The contending parties can conclude agreement of lawsuit.

My understanding of "disposition" here is that it has the sense of distribution: e.g. "Acte de disposition - instrument or legal transaction disposing of rights or property ..." (F.H.S. Bridge). In this case, the translation needs to be quite far removed from the French wording.
Chris, on the other hand, has apparently understood it in its sense of having at one's disposal. That would allow a translation that looks very similar to the French wording, but I think that it could be an instance of faux amis.
